A Utah woman was dealt a setback in her fight against criminal charges for being seen topless by her stepchildren in her own home when a judge upheld the state’s lewdness law on Tuesday.

Tilli Buchanan, who could face prison and be forced to register as a sex offender for 10 years if convicted, challenged the lewdness statute as unconstitutional on the grounds that it discriminates against women by making it illegal to show their breasts.

What's stupid is hanging drywall while under the influence of alcohol.

What's stupid is a state enacting laws that forbid actions that have no victims.

It sounds like this state law is the Utah equivalent to the Sharia law that forbids a woman showing her nose in public. Except that even that Sharia law allows the woman to show her nose in the privacy of her own home.

(1) As used in this section, "in the presence of" includes within visual contact through an electronic device.
(2) A person is guilty of lewdness involving a child if the person under circumstances not amounting to rape of a child, object rape of a child, sodomy upon a child, sexual abuse of a child, aggravated sexual abuse of a child, or an attempt to commit any of those offenses, intentionally or knowingly:
(a) does any of the following in the presence of a child who is under 14 years of age:
(i) performs an act of sexual intercourse or sodomy;
(ii) exposes his or her genitals, the female breast below the top of the areola, the buttocks, the anus, or the pubic area:
(A) in a public place; or
(B) in a private place under circumstances the person should know will likely cause affront or alarm or with the intent to arouse or gratify the sexual desire of the actor or the child;

I think she has a case that they were just hanging drywall, the children walked in, and she did not intentionally try to arouse the children.

Sounds like the ex-wife is just trying to use this as more ammo in a custody battle but the judge should have more common sense in this case.

3 women just lost a case in new england over the same thing.
I do not think that this is a sex abuse case.

i also think she is arguing the wrong thing. this is a violation of privacy.
although i have to question why she was hanging dry wall or whatever it was without a shirt on.

she could have kept her bra on, or they could have brought work shirts then who cares.
however i do not see this as a sexual abuse case.

it sounds like the guy's ex-wife is just creating trouble to create trouble.

Hmmmmmmmmmmmmm. I just came up with a great idea for a business, topless employees doing home improvement jobs. And you wouldn't have to worry about customers complaining about shoddy work or the job taking too long.

I noticed the police report also mentioned the woman had been drinking. Alcohol *and* boobies?!? She'll get the death penalty in UT.

Remember when one of Janet Jackson's nipples flashed on TV screens for a fraction of a second one time? People lost their blessed minds. I'm sometimes surprised that society manages to function at all.

She basically admitted to doing it willfully to make a point. Not sure what your issue is, unless you think the law shouldn't apply to her for some reason.
