EXCLUSIVE – Multiple administration officials tell Fox News that when Robert Mueller met with President Trump in May of 2017, Mueller was indeed pursuing the open post as the director of the FBI – something the former Russia probe special counsel denied under oath during congressional testimony this summer.
These officials also told Fox News government documents showed Mueller was pursuing the job as a candidate himself.
It came as emails released this month through a Freedom of Information Act request by the conservative group Judicial Watch seemed to indicate Mueller knew there was a real possibility he could be named special counsel if he wasn’t chosen as the next FBI director.

“The boss and his staff do not know about our discussions,” then-Deputy Attorney General Rod Rosenstein said in an email to Mueller on May 12, 2017. Rosenstein’s boss was then-Attorney General Jeff Sessions, who had recused himself from the Russia probe, meaning the president would not have known either.
A source close to Rosenstein confirmed to Fox News that he had confidential conversations with Mueller about whether he would be willing to serve in the event he needed to appoint a special counsel. These conversations began on May 12, 2017, prior to Mueller's meeting with the president on May 16, 2017, the source acknowledged.

On July 24, during his testimony before the Senate and under oath, Robert Mueller made this statement:

“My understanding of it was (I was) not applying for the job, I was asked to give my input on what it would take to do the job,” Mueller told the U.S. House Judiciary Committee at a hearing. “I interviewed with the president ... it was about the job, but not about me applying for the job.”

Robert Mueller had already over-served his prior yen year appointment by two years, and I find it hard to believe anyone could be so confused, unless of course they're still trying to discredit the entire Mueller investigation and vindicate Russia. Sounds logical to me. He was brought in to explain why the position is considered independent and why the Director should not be talked to directly and certainly never alone. For the benefit of both the Presidency and the Justice Department, the President must never be seen as applying pressure to that department. If the second purpose for Mueller to be there was to recommend the qualifications/traits of the person to fill it, or to discuss/recommend candidates for the position, then Trump has to plead dementia to think that the purpose was otherwise.

Good lord, the man had already served in that job longer than anyone other than its original occupant John Edgar Hoover. He retired in good standing and was receiving a government retirement in his 70’s. There is no more prestige he could have gotten by returning to be Director of the FBI again. Also, as Director he would have exposed himself and his retirement to the self-serving and asinine whims of Donald Trump—a man whose whole shtick before becoming President was saying “YOUR FIRED” after a completely non-coherent and uninformed decision making process on National TV. How stupid do you think he is?

It would be illegal to appoint Mueller to another term as FBI director.

"Effective with respect to any individual appointment by the Effective date.
President, by and with the advice and consent of the Senate, after
June 1,1973, the term of service of the Director of the Federal Bureau
of Investigation shall be ten years. A Director may not serve more
than one ten-year term. The provisions of subsections (a) through (c)
of section 8335 of title 5, United States Code, shall apply to any
individual appointed under this section."

I don’t understand what the issue is. The Trump administration asked a qualified person on their input regarding what it takes to do job.

Only in today’s political climate could that be news, or spun into some controversy.

Wow, this is big news! Mueller wanted to be FBI director...again. The administration should get right on it—instead of responding to requests from the House impeachment inquiry!
 


The law also says there are exceptions, as long as the President and the Senate agree. Mueller was head of the FBI for 12 years ... 2 years longer than the max 10 years.

So I don't see why he could not become head of the FBI, as long as the President and the Senate approved.

Law can be changed, but all and all, to appoint an FBI director twice it would require a House vote, two Senate votes, and a Presidential signature.
