The idea that being president shields one from any form of action, including Congressional and judicial subpoenas, is particularly absurd -- but I guess that's what the Trump team had to do -- reach for the moon, in order to keep their client's tax returns, which must be really, really juicy, from being released.

If we can remember all the way back to the 1990s, Bill Clinton had to answer subpoenas and court filings. Presidents don't have absolute immunity. It's even arguable that they are immune at all, since it doesn't say so in the Constitution.

This is false. Republican-appointed judges have ruled against Trump numerous times during his administration.

This was the judge's response:

Manhattan U.S. District Judge Victor Marrero rejected what he termed Trump's "extraordinary claim" that "the person who serves as president, while in office, enjoys absolute immunity from criminal process of any kind."

That claim is too broad, wrote Marrero, because it would represent "virtually limitless" protection from criminal investigations not only for sitting presidents but also associates who might have collaborated in potentially illegal actions.

"This court cannot endorse such a categorical and limitless assertion of presidential immunity from judicial process as being countenanced by the nation's constitutional plan, especially in light of the fundamental concerns of excessive abrogation of power that animated the Constitution's delicate structure and its calibrated balance of authority among the three branches of the national government, as well as between the federal and state authorities," wrote Marrero.

"Hence, the expansive notion of constitutional immunity invoked here to shield the president from judicial process would constitute an overreach of executive power."

one thing they ( New York ) are looking at is can they prosecute a sitting President.
Trump may not be prosecuted by the Fed. when in office but NY may have the right too.
Trump may be exempted from Fed. Prosecution but not state. ( that is the law )
NY can and should be doing more and look into Trumps business activities
and if they find wrong doing prosecute him

There is nothing in the Constitution that prohibits a sitting president from being prosecuted. There also is no statute that prohibits it. The only thing that states this is a memo from the DoJ Office of Legal Council. The argument is flimsy -- that a president's job is so star-spangled awesome that being tied up in court would hinder the functioning of the office. The flaw in this argument is the 25th Amendment, which allows the Vice President to act as president temporarily if the President cannot.

The history behind this goes back to when Spiro T. Agnew was VP under Nixon. Agnew was found to have taken bribes when governor of Maryland. The question was: can a sitting VP be prosecuted by a state? The DoJ opinion was that the VP was different from the Pres and could be prosecuted. The idea was that they were looking for a way to get Agnew to resign and trade not being jailed as a carrot.

This is uncharted legal territory. I was taught during the Nixon Era that a president is not above the law and that leads me to think that a president can be indicted federally and by the states.

What Trump didn't anticipate was a mentally unhinged leftist Judge violating the Fourth Amendment of the US Constitution. Unless there is probable cause that a crime has been, is in the process of being, or will be committed every individual has the right "to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures." Politicians have their public salary information available to the public, but private citizens do not. January 2017 would be when Trump became a politician and his tax returns became public. Prior to being sworn into office as President Trump was a private citizen and afforded the same protection under the Fourth Amendment as every other individual in the US.

Unless, apparently, they are Democrat scumbags who have become mentally unhinged after losing the last election. Then your constitutionally protected individual rights don't mean a damn thing. Once again the fascist left of the Democratic Party demonstrates its abject hatred for the US and every American.
