The violation occurred in March 2016 when DePaulo promoted then-presidential candidate Hillary Clinton's plan for immigration reform while presiding over a deportation hearing.


The individual at the public hearing was facing deportation and subsequent 10-year bar on re-entry to the United States, and DePaolo called that a "pretty harsh thing" that Clinton intended to change.

This would only change if "the Senate becomes a Democratic body and there's some hope that they can actually pass immigration legislation," DePaolo said. The Republicans, on the other hand, "aren't going to do anything" about immigration "if they can help it," other than to "try to deport everybody."


The administrative law judge found DePaolo's actions merited "a considerable sanction given the public nature of her position."
The decision imposed a $1,000 fine, the maximum civil penalty, along with a 30-month debarment from federal service since DePaolo has since retired.

First, she's was an administrative law judge, which is part of the executive branch, not the judiciary.
Second, nobody is getting rid of her. She's been retired.

DePaolo told CNBC that during a hearing on the disciplinary complaint against her last year she argued that “I didn’t violate the Hatch Act, I was conducting a deportation hearing.”


But what you bring up is selective enforcement of the law. The Hatch Act prohibit federal employees from making political statements in favor of or against political candidates. Kelly Ann Conway violated the Hatch Act multiple times in TV interviews and no actions were ever taken. So, we have an admin law judge saying something before the election and gets fined $1K but pro-Trump federal employees can do what they want with impunity.

Kerner’s office earlier this year recommended that Trump fire his senior advisor, Kellyanne Conway, for “persistent, notorious and deliberate Hatch Act violations” by promoting Trump’s relection and the defeat of Democratic candidates in media appearances.

Trump did not fire Conway.
