Trump Asserts He Can Force U.S. Companies to Leave China

Yes, it is the law, but Trump just can't declare a national emergency without actually backing it up with you know, facts. Which the facts do not support his declaring a national emergency. Not surprising that the hypocrite Trump supporters now support a president interfering with the private sector. Trump supporters keep proving their hypocrisy every day supporting Trump.

Trump has a good case as it pertains to certain industries and particularly when it comes to the manufacture of electronics. This is a good example of why:

In Supermicro, China’s spies appear to have found a perfect conduit for what U.S. officials now describe as the most significant supply chain attack known to have been carried out against American companies.”

Actually, it would have been a good thing if Obama had ordered all US corporations to get out of China...but, of course, not only didn't that not occur to him, he wasn't even interested in dealing with the issue of illegal and corrupt trade practices by the Chinese.

But even if he had been interested, all he would have done is tell them to "Cut it out!!"
The law that governs this specifically outlines an "unusual and extraordinary threat." Trump's usage of this provision is legally questionable. A prerequisite for use is to first declare and emergency, which he hasn't done. Apart from the legality, it is even more of a bad idea than one can imagine. American companies have invested many billions of dollars so that they can gain a piece of the Chinese market. GM alone sells more cars in China than they do in the U.S. Trump's shoot-from-the-hip directives, made based on impulse, not analysis, would do extraordinary harm to America.
 
He knows that. He is using the MSM media trolls to get the China problem in the forefront where it belongs. We need to disengage our supply chain from China. Industry can’t stand by and hope we are going to BOHICA when Trump is gone when he goes, and another weak president takes his place and continues to make unenforceable deals.

This is a permanent battle. Every dollar of Chinese surplus is invested in destroying the USA. Their stated national goal is to be the worlds manufacturer. Where does that leave us? We become a agricultural colony.


China is holding the better hand, they will just wait until after the election or when Trump leaves office. This is a country that starved millions of it's own citizens, they can withstand this far more than we can and they know it, and they also know that no democrat ( or traditional conservative) would be doing tariffs, so they are just waiting it out, and they can afford to.

If I was a Chinese leader living in China, I would have assumed Trump would have resigned over the Russia Hoax, and continued to bide my time. But now that that is over, I must assume he will lose the election based on what I read and gear from the media, so there is no point in doing business with him, since it appears those sympathetic to Chinese hegemony are likely to take over the country in 2020.

Can you blame them?

He doesn't need to declare it an emergency until he completely paints himself into a corner. Then it becomes an "emergency".
 
The question is whether or not it is an emergency that allows the POTUS authority over who can do business with China. Nothing you’ve described sounds like an emergency.

Any choice that can be put off for other means, is by definition NOT an emergency.

Given that declaring emergencies, particularly when there is none, giving Trump dictatorial powers, is too great of a temptation that he can resist.

Trump's abuse of emergency powers act will result in a revision of that policy, once he leaves office. No one imagined a narcissist dictator wannabe would ever become president when the law was made. The framers did their best, but there are aspects of Trump's character no one imagined. The EC was supposed to prevent a guy like him from ever becoming president, but it's original design was emasculated and no longer works as it was intended.

The irony. This was the guy that criticized Obama for overreach. Now, he flagrantly uses executive orders and unilaterally imposes tariffs cavalierly, when the laws specifically give the president the power to impose tariffs for national security grounds.

If challenged in court, I think the courts would rule this situation is not within his authority. That's the legal argument. The next question is whether it's a good idea? American companies have invested billions of dollars on the Chinese market. Now, Trump wants them to abandon those investments and build somewhere else. I think that if my objective was to cause a massive recession, shutting down trade would be one of the elements that I would use. A second way would be trying to undermine an independent Federal Reserve.

The Chinese flag should be flown at all Democratic political events and candidates gatherings.

There are no "dictatorial powers". Just laws. There is no "abuse". Just use of those laws.

The framers didn't write the laws. Congress and Presidents did.

The Electoral College has worked as it was intended...every election.
