Trump moves to eliminate nearly all asylum claims at U.S. southern border

The Trump administration moved Monday to effectively end asylum for any migrant who arrives at the U.S.-Mexico border, an enormous shift in U.S. immigration policy that could block hundreds of thousands of people from seeking protection in the U.S. — and is certain to draw legal challenges.

The new rule, published in the Federal Register and set to take effect Tuesday, would bar asylum claims for nearly all migrants from any country. It would do so by prohibiting claims from anyone who has passed through another country en route to the U.S., which essentially would cover anyone other than Mexican residents.

Only in rare cases, such as when a migrant applies for asylum elsewhere and is denied, would a person be eligible to apply for protection in the U.S.

In light of the Democrats dragging their feet on solutions that would fix immigration loophole in present law, what's a president to do?
The Democrats cannot complain about the crowded inhumane conditions in border detention camps and sit back and oppose reasonable checks that will preclude our system from staying overwhelmed. Kudos to the Trump administration for taking this necessary move.
Of course the shift will draw legal challenges but the new proposals are certainly worth the try to keep people from shattering our system.

Nope, that would be Republicans. Even under the Bush administration when he tried to pass immigration reform it was Republicans in Congress that blocked it not Democrats.

This is an implicit admission by the tRump administration that entering our country to seek asylum is legal under US and international law.

We have a backup of 900,000 people! Considering that ~90% do not meet asylum claims, they are causing the mother of all backups in the system for those with an actual claim of asylum.

Let's stay in the present, shall we?
Trump has presented solutions to fix asylum loopholes in the law and the Democrats laugh.

Trump Delays Immigration Raids, Gives Democrats 2 Weeks For Asylum Law Changes : NPR

Fast forward, two weeks later... While reluctantly going along with Trump's humanitarian aid proposals, the Democrats could have addressed asylum loopholes, but they didn't.

We have a backup of 900,000 people! Considering that ~90% do not meet asylum claims, they are causing the mother of all backups in the system for those with an actual claim of asylum.

Unreal! 900,00 backup and the Dems keep crying that it's all about the kids. One could cut the irony with a dull knife!

The Democrats and their lackeys can continue on with the vapid moral lecturing but the truth always prevails.
They are complicit for the overcrowded conditions in migrant detention centers because in fact, they have NO interest in changing the asylum part of our immigration law.

Thankfully, we have a president who cares about the loophole in our immigration law that keeps asylees pouring into our country and stressing our resources to the max.

Where did Trump say seeking asylum is not legal?

Oh wait, he didn't.

It's not as if Dems are indifferent to the border crisis. They intentionally denied the growing humanitarian crisis in a cynical bid to see it intensify and become a dumpster fire. Then they all yell in unison, "J'accuse Trump!" So think about it. Trump has been warning about this crisis. Border officials have been called before Congress to testify and have BEGGED and IMPLORED for help, but all Democrats could do was scream in unison, "Ripping babieeeeeeeeeeeeeeeeeeeeeeeeeeeeeeees!".

IOW, don't look over there at the thousands of migrants invading our border! Look back there when Trump implemented a zero-tolerance policy!

Democrats needed the suffering at the border and for the system to be overwhelmed, so they could say, "See, this is cruel and we need to abolish ICE and DHS and oh by the way, CBP agents are concentration camp guards. We must decriminalize and never hold anyone in detention again!"

And then they beat the racist drum and we're off the the races, on our way to see a country with no borders and no citizens. Only "residents" who are all equal and all get to live off the welfare state.

Average backlog-- 727 days.

But I thought that Trump's people don't mind "as long as people come here legally?"
Asking for asylum was legal.

Where did Trump say seeking asylum is not legal?

Evading CBP and evading the law=not asylum. The leftists will insist that anyone who crosses not using our ports of entry qualifies as an asylum seeker, but that's not the case.

Well, think about it and I don't know how anyone can disagree. If everyone came here through our LEGAL ports of entry, they would be processed quickly and in an orderly fashion. Detention would be minimal and far less crowded. True asylum seekers would not have to wait amongst the 90%, or roughly 600,000 other people claiming asylum who do not qualify.
Come here legally= go to a legal port of entry and don't make false claims which suck time, money and energy out of our system and prevent our resources from focusing on actual claims.

For those coming to work- Congress needs to pass legislation making it easier to migrants to work here and that do NOT involve any advantage from dragging kids along.

Meanwhile three more privately owned for profit alien detention centers just went online, in direct defiance of explicit instructions from Congress.

ICE had the capacity to detain only about 2,000 people in Louisiana and Mississippi at the start of Donald Trump’s presidency. But contracts signed with private prison companies in the past year have pushed ICE’s capacity in those states above 10,000 people. The horrifying conditions uncovered by Mother Jones at the Winn Correctional Center in Louisiana and by The Nation at Adams County helped push Barack Obama’s Justice Department to move to end its use of private prisons. Since June, ICE has started sending asylum seekers to both of those prisons.

Concentrating asylum seekers in Southern states makes it particularly likely that they will lose their cases because of the region’s harsh judges and shortage of immigration lawyers. There are not enough judges in Louisiana to hear the new cases, and there are no immigration courts in Mississippi.

NICE GOING! :applaud

How would you argue that in court given the statute?

(a) Authority to apply for asylum
(1) In general
Any alien who is physically present in the United States or who arrives in the United States (whether or not at a designated port of arrival and including an alien who is brought to the United States after having been interdicted in international or United States waters), irrespective of such alien’s status, may apply for asylum in accordance with this section or, where applicable, section 1225(b) of this title.

I give it less than a month before a federal court imposes and injunction...

This is a blatant contradiction of the statute and will not be upheld.

Where does this number come from?

The new changes are designed specifically to cause violence and chaos at the border and to drive up illegal border crossings. There is no way it can do otherwise.

Trump started "metering" asylum seekers crossing at ports of entry, letting a very small number in each and making the rest wait on the Mexican side of the border. There are thousands of people waiting in crowded, camps waiting their "turn" to enter. Once word that these people, many of whom have been waiting patiently for months, as they were asked, to make their cases for asylum, will never get in, all hell will break loose. Thousands more didn't have the resources to wait, and made illegal crossings, driving up the numbers Trump touts as "illegal crossings" and giving DHS staff and excuse to take their children from them.

When these thousands of desperate people learn that after months of waiting, they will never even get the chance to get in, how do you think they're react? Do you really think they'll say "We tried. Oh well, lets go home?". If you believe that, I have a lovely ski resort in Miami I'd like to talk to you about. This will end in chaos and violence, which is of course, exact what Trump is hoping.

I just have a simple question, why aren't these "asylum" seekers, seeking asylum in Mexico?

This will be challenged in court faster than Trump can say covfefe.

It is clearly contrary to US asylum laws and international treaties the US has signed.

I mentioned there would no doubt be legal hurdles in the O/P.
And if this happens, the onus then falls on the Democrats to tighten present immigration loopholes.
They are done talking out of both sides of their pie holes without being called on their complicity to the inhumane overcrowding in detention centers.

Link for the latter, plz.

Eh, maybe. But ICE needs to explain how it is that $775 per day per person only buys the conditions we’re seeing before they’re given any more money.

Why do less than the 1/5 who claim asylum get granted asylum? Because they aren't really coming to the U.S. for asylum. They are coming for a better economic opportunity than MX offers.

Many evade CBP and are captured. That's not asylum.
