I didn't say they should, only that in this case the PRIMARY motive of the crime was him being a Trump supporter not his age. Therefore no hate crime law is applicable in this situation.

When has hate crimes laws been subject to court approval?

When has some lawyer attempted to make the validity of hate crimes laws a test case for courts?
As far as I know, legislature has passed hate crimes laws. Just like state legislatures passed Jim Crow laws.

Whenever someone has been charged with a hate crime and been sentenced for it.

Hate crimes have been legislated by congress. No judge has deliberated on the validity of hate crimes...as judges positively have with whether corporations can have the same privileges as persons.

That's because no one has successfully appealed hate crime laws because they are ……./drumroll...….constitutional. Ta daaaaaaaaaa!

How can you tell if hate crimes laws are constitutional if they've never been challenged in courts? Hum?

They haven't been challenged because it has been accepted that they are constitutional. Tell you what, if you don't believe me go out and commit a crime that falls under hate crime laws and then you can appeal it and see what happens. Do you want to make a bet how your appeal will go?

I'll give you a hint, there is a REASON why no one is challenging hate crime laws, because they are (as I said before)...………….constitutional.
