Former Army intelligence analyst Chelsea Manning was sent back to jail Thursday after refusing for a second time to comply with a grand jury investigating WikiLeaks and its founder, Julian Assange.

"Facing jail again, potentially today, doesn't change my stance," Manning told reporters in Alexandria, Va., before U.S. District Judge Anthony Trenga said she was in contempt of court.

Anyone else find it kind of hypocritical that Manning is sent to prison for refusing to honor a subpoena by a Justice Dept. that is run by a man who refuses to honor a subpoena?
 
Not really, considering they aren’t close to being comparable situations.

So how is the DoJ and the Treasury Dpt. above the law? How do you justify the two scenarios?

This case is a criminal proceeding, the other isn’t.

One can ignore subpoenas in non-criminal proceeding? Then what is the point in having them?

She is not a member of the Executive branch. In fact she is a member of the “yesterday’s news” branch. However, it tells me a Grand Jury is in session. When it’s over they will spring her. So, some aspect of Wikileaks is still in play it appears. Probably an extradition case against Assange.
 
I'm conflicted. Namely because Manning deserves to be locked away in a cell forever, but also because the people who are attempting to imprison her are also doing so with blatant hypocrisy.
 
Of course one can, if it’s an issue regarding separation of powers.

Show me the part of the constitution that gives the attorney general immunity from subpoenas.

What about checks and balances? If Congress cannot hold executive branch employees accountable for their behavior, what is to stop the DOJ from committing any crime they choose?

Are you of the opinion that when the USSC ruled 8-0 that Nixon had to honor a subpoena they ruled in error?

I hope it stays in prison ... until the 35-year sentence is completed.

I’m not familiar with specifics of that ruling, so no, I don’t hold that opinion.

Checks and balances doesn’t mean that one branch is superior to another. Congress’s oversight authority isn’t unlimited.
