More than 370 former federal prosecutors who worked in Republican and Democratic administrations have signed on to a statement asserting special counsel Robert S. Mueller III’s findings would have produced obstruction charges against President Trump — if not for the office he held.

The statement — signed by myriad former career government employees as well as high-profile political appointees — offers a rebuttal to Attorney General William P. Barr’s determination that the evidence Mueller uncovered was “not sufficient” to establish that Trump committed a crime.

Mueller followed OLC guidance.

From Barr's letter:

The Special Counsel's decision to describe the facts of his obstruction investigation without reaching any legal conclusions leaves it to the Attorney General to determine whether the conduct described in the report constitutes a crime. Over the course of the investigation, the Special Counsel's office engaged in discussions with certain Department officials regarding many of the legal and factual matters at issue in the Special Counsel's obstruction investigation. After reviewing the Special Counsel's final report on these issues; consulting with Department officials, including the Office of Legal Counsel; and applying the principles of federal prosecution that guide our charging decisions, Deputy Attorney General Rod Rosenstein and I have concluded that the evidence developed during the Special Counsel's investigation is not sufficient to establish that the President committed an obstruction-of-justice offense. Our determination was made without regard to, and is not based on, the constitutional considerations that surround the indictment and criminal prosecution of a sitting president.

It's over.... There will be no obstruction charge!

Mueller made it absolutely clear in his summary of volume II that it was OLC guidelines that prevented him from even concluding a crime was committed, let alone from indicting him. So while the opinion of 370 former prosecutors puts the icing on the cake, Mueller's own words are pretty clear.

Pretty damning report on how Trump operates eh? Asking WH staff to lie and present false statements to a Federal Investigation. All of this an official report, Americans will decide Nov 2020 if this is behaviour acceptable from a President.

Confirmed, Trump is a criminal. We all knew this after the Mueller report was released but it's always nice to hear it again.

“Each of us believes that the conduct of President Trump described Special Counsel Robert Mueller’s Report would, in the case of any other person not covered by the Office of Legal Counsel policy against indicting a sitting President, result in multiple felony charges for obstruction of justice. We emphasize that these are not matters of close professional judgment ( ← this sentence essentially says that their conclusion is professionally obvious - RV). Of course, there are potential defenses or arguments that could be raised in response to an indictment of the nature we describe here . . . But, to look at these facts and say that a prosecutor could not probably sustain a conviction for obstruction of justice — the standard set out in Principles of Federal Prosecution — runs counter to logic and our experience.”

What they are saying in essence is that only the office of president and OLC policy saves Donald Trump from being indicted for obstruction of justice. They also state that this conclusion is obvious to anyone with US federal prosecutor experience, and they strongly suggest that William Barr's bastardized 'interpretation of obstruction' runs counter to the standard principals and precepts of law as understood and applied in the field of federal prosecution.
