Mueller Left Open the Door to Charging Trump After He Leaves Office

The Constitution of the United States prohibits the government from accusing a person or an organization of being a criminal without a forum for them to defend themselves or clear their names.

Yes,that is a given. It's part of Habeas Corpus.Plus especially troubling when Unelected
people { prosecutors } and those like this Mueller Mug decide an American's fate w/o
having the opportunity to face any accusers.

No more so than JAmes Comey deciding and announcing Hillary's exoneration.
That was THE Responsibility of Loretta Lynch as AG.

Suspicious as it was, Lynch gave Comey the responsibility of her, the AG, in the Hillary matter and he suggested the poor dear didn't mean to do those illegal things so she could continue campaigning and btw, I'm available for FBI chief in her Administration. That last part was my editorial comment.

Mueller is not going to decide the fate of the president. That is left to the Congress. Now they need to hold hearings, hear testimony of people in the report to determine if the behavior of the president rises to the level of "high crimes and misdemeanors." That is their job. That is their responsibility. In the end, the Senate may very well decide that the president's behavior does not rise to that standard. In which case it will all be behind us. The problem for the president is that it will all be out in the open. We will get to hear what these various people have to say. We will get to hear Trump and Sanders and Conway all declare they are all liars, every last one of them.

“Third, we considered whether to evaluate the conduct we investigated under the Justice Manual standards governing prosecution and declination decisions, but we determined not to apply an approach that could potentially result in a judgment that the President committed crimes.”

Fairness concerns counseled against potentially reaching that judgment when no charges can be brought.
The ordinary means for an individual to respond to an accusation is through an speedy and public trial, with all the procedural protections that surround a criminal case. An individual who believes he was wrongly accused can use that process to seek to clear his name. In contrast, a prosecutor’s judgment that crimes were committed, but that no charges will be brought, affords no such adversarial opportunity for public name-clearing before an impartial adjudicator.”

“Fourth, if we had confidence after a thorough investigation of the facts that the President clearly did not commit obstruction of justice, we would so state. Based on the facts and the applicable legal standards, however, we are unable to reach that judgment. The evidence we obtained about the President’s actions and intent presents difficult issues that prevent us from conclusively determining that no criminal conduct occurred. Accordingly, while this report does not conclude that the President committed a crime, it also does not exonerate him.”

OK, not DOJ policy: The Constitution of the United States prohibits the government from accusing a person or an organization of being a criminal without a forum for them to defend themselves or clear their names.

Does not change the conclusion that the President is not innocent.

Yes,because we { all americans } know that if a person is found to have commited no
crime it does not rise to the level as being " not innocent ".
Not guilty meaning Innocent and Not innocent meaning guilty.
I guess one could also make the case that a Court room is actually a Fun House.
That Butterflies are only as free as determined by a majority in Congress.

Did not Mueller and his Prosecutors believe they could subpoena { for an Indictment }
a sitting,duly elected POTUS.
Of course they did.But they also knew that DOJ Policy does not allow it and
the President could fight it all the way to the Supreme Court.

Sorry but Loretta Lynch and Comey { Both } had no legal basis for making that decision.
That Lynch { newly installed } arranged for the F.B.I. Director to announce Hillary's exoneration.
Just like Lynch had no right to confer { hold a private conversation with the Husband of
the Person { Hillary } she was Investigating.Billo Clinton for 40 minutes on a Phoenix tarmac.
Right there Lynch could have been made to resign. She broke all kinds of Protocol
as did Comey.Who leaked classified Info to the Press.

I'm not arguing with you about Lynch. I don't think she had the authority to do that. I thought that I was clear.

It's Mueller's fault there's no page 214. I have a page 214 in a whole lot of my books.

Some people do not realize that the "PDF page numbers" do not always align perfectly with the "document page numbers".
