Nielsen had to be replaced because although she put kids in cages, she just wasn't as mean as Trump wanted the DHS to be or faithfully comply with stupid policies. Trump in recent weeks had asked Ms. Nielsen to close the ports of entry along the border and to stop accepting asylum seekers, which Ms. Nielsen found ineffective and inappropriate and other experts said would hurt the economy.

If anyone cares to push it, then this "pick" can be challenged as this was not a lawful move. Should be Under Secretary for Management, Claire Grady. According to 6 U.S. Code § 113(g)(1):

(1) Absence, disability, or vacancy of Secretary or Deputy Secretary
Notwithstanding chapter 33 of title 5, the Under Secretary for Management shall serve as the Acting Secretary if by reason of absence, disability, or vacancy in office, neither the Secretary nor Deputy Secretary is available to exercise the duties of the Office of the Secretary.

Seems Trump can't even pick an acting head without breaking a law.

That is in..section 33.....what you posted literally said, NOTWITHSTANDING OF Section 33 of Title 5.....or Chapter 33.....

You say he broke the law making the appointment, and yet, it's well within his right, to make that appointment.

If Trump wants a DHS secretary who looks the part of a law enforcement official, McAleenan — a career border officer — is a better fit. If he wants someone who can talk tough in front of the cameras, McAleenan might not be a good fit for exactly the same reasons; he hasn’t been as willing to blame either Democrats or migrants themselves for the current situation at the border as other Trump officials, including Nielsen.

Trump could nominate someone more rhetorically aggressive, like occasional adviser Kris Kobach, but he could face an uphill battle in the US Senate.

But if Trump wants a DHS secretary who will stop people from setting foot on US soil, none of these options will satisfy him. Neither will anyone else.
