(CNN)Former national security adviser Michael Flynn is still cooperating with Justice Department prosecutors on a pending criminal case against his former lobbying partner who worked for the Turkish government, the special counsel's office and Flynn's defense team said Tuesday night.

Flynn is asking not to move to sentencing yet, but the government says his cooperation is complete beyond testifying at an upcoming trial.
"There may be additional cooperation for the defendant to provide pursuant to the plea agreement" with special counsel Robert Mueller's office, Flynn's attorneys and special counsel prosecutors wrote on Tuesday. However, "in the government's view his cooperation is otherwise complete," they wrote.
A federal judge in DC asked for the update after Flynn requested to delay his sentencing in December.

Flynn went before the judge, Emmet Sullivan of DC District Court, in December, with Mueller's team asking for as little as no prison time for his lying charge, but the judge grew angry about Flynn's crimes during the hearing and encouraged him to continue cooperating.

The continuous delays in Micheal Flynn's sentencing have been the subject of wild & rampant speculation, from both Flynn's supporters and detractors. Some have believed the delays point to Mueller's investigation of Flynn being illegitimate, while others believed the delays point to Flynn providing assistance to Mueller to "work his way up the ladder" of the Trump administration.

This article now, seems to be implying a more prosaic reality: Mueller is done with Flynn, and Flynn is working on another case not under Mueller's active purview, in order to assure he stays out of jail.

Just thought I'd post this update.

It's probably a little of both.

I think Judge Sullivan gave Flynn a wake up call. Yes, I think he’s trying to reduce his potential sentence. He’s a corrupt general who got caught. Sullivan was wondering why Flynn was not charged with treason.

Couple thoughts, Chomsky.

1. Prosecutors typically don't offer the kind of no jail time recommendation that the SC team did, unless a witness helps towards an indictment.

So, what indictments use Flynn's assistance?

2. It was odd for the judge to call defrauding of FARA treasonous and selling the country out, and not feel Flynn's cooperation was enough to warrant a no jail sentence. I mean, defrauding FARA is bad, but judges don't flip out like that over it.

One possibility is that it is the unredacted parts the judge was outraged over, not Flynn's FARA work.

I mean to say that the redacted parts of Flynn's work might be what cause the judge to be furious, not the unredacted parts.

Trix, are you implying Flynn not being sentenced because Mueller's investigation of him is illegitimate?

I understand what he copped to was not a crime, and there is a real question of whether he should have been charged at all. Comey himself said they saw him as low hanging fruit when he actually agreed to “have a friendly chat” with no lawyer present, which in a more politically astute organization would have seen the attack coming and required the WH counsels office sit in.

Comey played him because he could, and broke FBI and DoJ rules doing it.

Then we have the need to unravel the reported prison threats to his family that got him to plea to things he didn’t do. Flynn, from all reports was a hapless victim of the FBI’s over exuberance in going after Trump. Flynn probably doesnt trust mueller team to keep their word, or his attorneys are playing a longer game.

Um, no.

Flynn was the head of the DIA and a seasoned general, he knew that lying to the FBI (which he did), lying to the DoD (which he did), and hiding money he had gained from illegal foreign lobbying (which he did), where all clear cut, illegal actions, which he double and in some cases, tripled down on several times, before Mueller finally did something about it.

This also doesn't even touch his treasonous plot to kidnap a Turkish cleric and hand him over to fascists in Turkey, who would surely kill this man, all for his own financial gain.

Mueller is letting him off easy.

Back to the breaking the law isn't a crime defense, eh? That old chestnut

So Flynn is either a liar, an idiot or both?

So Flynn is either a liar, an idiot or both?

Flynn isn’t an idiot. He is a selfish, arrogant blowhard, but he is actually very intelligent when he puts his mind to something. At least in his capacity as a military officer.

That's what I thought too. So.....

Although that may be about what some folks wonder and postulate, I just want to know why Flynn lied about the stuff he did. Flynn lied about having interactions that, on the face of it, weren't illegal to have. Why?

Flynn's lying is comparable to a federal investigator asking one if one was at "XYZ" Nevada brothel last night, and one saying one wasn't when one indeed was. It's not illegal in NV to be in a brothel. There's no reason to lie about it and, by doing so, risk being charged with a Section 1001 offense if/when the investigator finds out one had lied.

To this day, we have yet to find out why specifically Flynn, or anyone else who's been charged in the Russia investigation, lied. What the hell were/are those people hiding and why are they hiding it?

Trix, are you implying Flynn not being sentenced because Mueller's investigation of him is illegitimate?

I am not saying Flynn is innocent of his charges.
I'm saying the Mueller investigation was a trumped up illegitimate witch hunt to get Trump. Flynn was just a casualty along the way.

Yes, to the bolded. It seems to be this Judge, and Judge Amy Jackson, know a lot more than we the public do, and whatever it is, it is really inflaming them.

The Russian investigation was a politically necessary congressional investigation, that was led by a fully Republican controlled Congress that was relatively harmless to Trump, and would have ended in obscurity in 6 mos or so.

Trump brought Mueller on, when he erroneously fired Comey. It will go down as one of the worst political blunders in modern Presidential history.

Don’t forget the Comeys second in command Rod Rosenstein recommended to Trump that Comey be fired. Also, it was nowhere near his job to pull his “no prosecutor would charge stunt” on national TV on the eve of the election.

That, Kemosabe, is the worst legal blunder, ever!

It's perfectly legitimate - ask the DOJ. Also that 'was' should be 'is' because it's not over yet.

Remember the true purpose is to investigate Russian interference in the election. Of that they've found plenty of evidence and they've also uncovered further crimes along the way. That the trail leads to the trump campaign and its meetings with Russian agents is nobody's fault but those who foolishly left so many crumbs to follow.
