so? Because an asylee is denied you think that means that their case wasn't legitimate? Just recently an asylum seeker, that was transgender, was denied asylum....deported to El Salvador, then kidnapped, tortured and murdered.

Your example is based on an individual situation. In which an individual person suffered a potential HATE crime by another. COMPLETELY Despicable. But does it qualify the Scope and the intent of the asylum clause
So there is limited details.
1) Was she in fact persecuted. As we DO NOT know the FULL details of why she was in fact killed. It is fact that a transgedner was KILLED, but there is NO factual basis from the 3 reporting sources that state it was a HATE crime or persecution of gender.
2) The Nation of El Salvador has a HATE crime law. so a government or a particular faction is NOT acting upon a specified persecution. (As we do NOT know the factual details)
3) The burden of proof does in FACT lay on the one claiming. MAYBE USCIS got it wrong, maybe the reviews/case mangers got it wrong. But the fact is that she was denied then Deported BACK to here country as they did NOT find credible evidence.
4) This example doesn't really validates the point you are trying to imply.
4a) Did they apply legally to enter the US? No, they arrived within a Caravan with no legal documents, but legally applied for Asylum
4b) Did they prove credible evidence of fear- No as their case was denied
4c) They were then deported back to their country.
4d) their untimely death COMPLETELY inexcusable and disgusting does NOT validate if it was an actual Hate crime or related to persecution (no factual details yet) With that El Salvador has LEGAL Laws protecting LGBTQ period so the country itself is NOT persecuting Transgender and THUS the responsibility of the Origin nation to protect its own people.
