When the Caravan reaches the port of entry. They are stopped at the border. They will be asked to present identification and travel documents. If they have NONE. they either turn around. OR they can claim asylum. IF they claim asylum and the CROSS into the US..... They are NOW entering the US undocumented and unlawfully THEY ARE ILLEGAL. They will have an immediate voluntary deportation order. BUT.... When they file the i-589 it will FREEZE the deportation order ONLY. THEY ARE STILL ON US SOIL UN DOCUMENTED and UNLAWFULLY or.... ILLEGALLY.
During the i-589 process they will be given a case manger were they will edify if they are of CREDIBLE FEAR. By statics 30% are approved meaning 70% will NOT have a credible fear established. Their I-589 application will be withdrawn. The Freeze order on their Deportation Order will be removed and they will need to leave the country as they are CURRENTLY in the US Unlawfully and Illegally.
If the Credible fear is established or the 30%. They will receive a court hearing and if approved an ADJUSTMENT of STATUS that will change their status from Undocumented Immigrate to "Legal Resident"
ONLY those that have the approval of Asylum will receive an adjustment of status.
So 1000 caravan members Claim asylum.... ALL will be charged with Unlawful entry into the US they are Illegal.
300 Will likely qualify for Asylum. they will get an Adjustment of status to "Legal resident"
the other 700 will still be illegal as undocumented and will be deported.
Asking for ASYLUM does NOT change your status, APPROVAL of Asylum changes your status. DURING the asking process YOU ARE STILL an Illegal Immigrant.......YOU have still unlawfully entered the US. And 30% Will likely get approved the other 70% are illegal.
MORE so now if TRUMP issues zero asylum ALL are illegal PERIOD as we can CAP how many ASYLUMS case we are willing claim, Asylum is NOT a Constitutional Right afford. .
