US to end Treaty of Amity with Iran after ICJ ruling

The US will pull out of a decades-old treaty with Iran which was used by Tehran as a basis for a case at the International Court of Justice (ICJ), Secretary of State Mike Pompeo said.

Iran took the US to court after it re-imposed sanctions on the back of abandoning a nuclear deal in May.

Iran argued that decision violated the terms of the 1955 Treaty of Amity.

But after the ICJ ordered the US to ease sanctions on Wednesday, Mr Pompeo said the treaty would be terminated.

COMMENT:-

I suppose that the adult thing to do if you are found to have been breaking the rules is to tear up the rules, then take your bat and ball home with you so that the other kids can't play soccer.

This will make it sooooooooo much easier to negotiate treaties in the future!

You can find the actual Treaty here: IRAN: The 1955 Treaty of Amity, Economic Relations and Consular Rights

Of special note see:

Article XXIII 3. Either High Contracting Party may, by giving one year's written notice to the other High Contracting Party, terminate the present Treaty at the end of the initial ten-year period or at any time thereafter.
IRAN: The 1955 Treaty of Amity, Economic Relations and Consular Rights

However, IMO several things should be recognized.

1. This agreement was entered into with the government of the Shah of Iran.

2. The new regime violated the terms when it seized the U.S. Embassy and any consulate offices and held U.S. citizens hostage. (see Article XIII)

3. Again when they attack U.S. ships in the gulf. (see Article X).

I am surprised that our government didn't abrogate the treaty after that.

You know, here I was thinking it's been a while since the United States got into a war with a Middle Eastern country.

Thank you for the juvenile explanation.

And you fumbled the play by mangling your sports games among baseball, cricket, soccer. We know however you're up there in lower mainland BC where playgrounds are plentiful and Canada is a minor strategic player -- at best. A lightweight nuisance overall in US-Iran antagonisms.

The report acknowledged that the American boats were in Iranian waters, but said Iran had violated international law by preventing them from leaving. “These two boats and their crew members had every right to be where they were on that day,” Admiral Richardson said at a news conference at the Pentagon.

Although the Iranians were within their rights to investigate why the boats were near the island, Navy officials said, they violated international law by holding the sailors at gunpoint, videotaping interviews with them and damaging equipment on their boats.

Adults deal in statecraft to which treaties and diplomacy are central. Iran has been of a much greater importance to the Pentagon than to the state department for a hundred years now. Gen. Mattis was early retired from chief of US Central Command in 2013 because he is the standard issued Pentagon hawk on Iran who could not silence himself. Yet Mattis supported the now negated Agreement negotiated by the P-5 + 1 on nuclear development by Iran.

The ayatollahs and the US have been shoving and shouting at one another for more than 40 years. There is zero amity between 'em. Yes, making it official is a mere formality. The point is Iran is the geostrategic center of south Asia between India, Turkey, Russia. Iran elites are predominantly hostile toward the United States and they are going to be neutered one way or another. Get used to it.

Why did Iran stop harassing US Navy ships?

The Iranian military has stopped harassing U.S. Naval vessels in the Persian Gulf, a move that U.S. military officials welcome but cannot explain.
“It seems like they’ve absolutely made a conscious decision to give us more space,” Navy Cmdr. William Urban recently said. “That is definitely a change in their behavior.” The Trump administration gave no official warning to Iran over the naval incidents, but instead, “the unpredictability of Trump has made Iran more reticent to test American red lines.” However, Iran continues to harass U.S. sailors with the use of drones, otherwise referred to as unmanned aerial vehicles.

Those who only see the USA as wrong wrong wrong have zero credibility. They too get stamped and tossed onto the reject stack.

That treaty wasn't made with the current government. The current government voided the treaty in 1979, when they overthrow thelegitimate government, then took 53 Americans hostage and tortured them.

While the treaty might have been "violated", that does not mean that it was "voided" - especially since the US government has relied on the terms of the treaty since 1979.

PS - The American hostages were not treated any worse than were "detainees" held by the US government (in fact they were treated much better) and not a single one of the American hostages is still being "detained" by the government of Iran.
