Medical marijuana or guns? Oklahoma latest state forced to choose


Oklahoma became the 30th state to legalize medical marijuana earlier this week, but residents who want to have a medical cannabis card and own a gun may see their hopes go up in smoke.

On Thursday, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) confirmed to ABC affiliate KOCO-TV that the conditions of a 2011 open letter, which states that federal law prohibits anybone who is an "unlawful user of or addicted to any controlled substance" from "possessing firearms or ammunition," still stands. The letter says that anyone who uses marijuana, regardless of state law, qualifies as an "unlawful user of" the controlled substance, and is therefore prohibited from owning a gun.

Federal officials went on to say that possession of a medical marijuana card was reasonable cause to suspect the card owner of being an unlawful marijuana user, even if the person obtained the card legally.

COMMENT:-

Anyone who wants to hold their breath waiting for Mr. Trump's supporters to come out swinging against this "Gun Grabbing" federal policy has my blessing - although I suggest that they call 911 first so that the ambulance people can resuscitate them when they pass out from hypoxia.​

This is gonna confuse a lot of rightists come election day. The way to restore the right to bear arms is to make pot legal in the US or to allow junkies to CC.

What exactly does this have to do with Trump? Per your own article its been around since 2011. Seems to me that CBS is just filling up air time with this.
 
That's...odd. It's just the federal government trying to impose itself over State decisions. OK should have just went the full 9-yards and legalized pot. Then there's no medical marijuana card for the feds to try to take people's guns away with.

They're only forced to choose because Marijuana is still a controlled substance.

I keep hoping Trump will try to legalize it.

He might if it isn't by the 2020 election.
 
This mess will continue to get worse, all the Federal Level has to do is legalize marijuana and so many problems are handled.
 
why discriminate against those that use medical marijuana?

why not keep the guns away from everyone that uses ANY drug known to mankind?

This will eventually be fought in the courts & IMO 'the people' will eventually win the court battles

Most all the so called righties i know are all for legalization of pot. The sin tax revenue would help reduce the tax burden of non users. Trump himself seems to favour it. Sessions is the only person I've seen been really vocal about the evils of the devil's lettuce in this administration. Obama had 8 years to work on or change the classification of pot and did nothing, seems both parties are ok with the status quo on pot for now.

Not a thing (other than the fact that the President of the United States of America is the person who is in charge of how the laws of the United States of America are ADMINISTERED and could solve the whole issue simply by issuing a directive to the effect that "Possession of a legally issued medical marijuana permit is NOT to be deemed evidence of illegal consumption of marijuana."

Besides, I didn't say "Mr. Trump" - I said "Mr. Trump's supporters"

Trump has rescinded all kinds of Obama era rules, often with very public signing ceremonies. Why is he unable to change this one? Is the ATF not part of the executive branch headed by Trump?

There are some stark inconsistencies with the arguments used re legal medicinal marijuana and private ownership of firearms.

The APA is quick to point out that having a mental illness doesnt in and of itself make one more prone to violence. Marijuana users and defenders are quick to claim that medicinal and even recreational use of marijuana is mellowing.

Seems to me that based on their arguments...marijuana users would make the safest gun owners.

So the answer is to decriminalize it at the Federal level, problem solved.

I'd rather face a armed robber high on pot than one drunk if forced to make a choice, but in general I'd think we'd all agree handling firearms while high on any drug is a pretty bad idea.

But as a general comment, I agree. Firearms in a home with a drunk are very likely far more dangerous than firearms in a home with a regular pot user. Alcohol tends to make quite a few of us violent for some reason, and I've never seen that kind of thing from people high on pot, although my experience with pot is pretty limited.

Sure.

Its ridiculous to ban gun ownership by medicinal marijuana users. If it ever gets passed...the gun ban will be challenged...most likely successfully.
