President Trump's attorney, Rudy Giuliani, told Fox News on Wednesday that special counsel Robert Mueller has told the president's legal team he will follow Justice Department guidance and not seek an indictment against Trump.

Giuliani, himself a former federal prosecutor and mayor of New York City, also told Fox News that Mueller's investigators have not responded to five information requests from the president's team. That has forced Trump's legal team to push off making a decision about whether the president will sit for an interview with the special counsel -- a decision they had hoped to reach by Thursday.

The precedent that federal prosecutors cannot indict a sitting president is laid out in a 1999 Justice Department memo. Giuliani told Fox News that Mueller has no choice but to follow its guidance.

"This case is essentially over," Giuliani said. "They're just in denial."

Probably need to watch this one and see how it plays out. I highly doubt Fox News could have gotten Rudy on camera before the NYT and CNN knew about it.

FWIW, there was never much talk of indicting Trump beyond that which came from talking heads on CNN/MSNBC and various political discussion forums. The objective has, pretty much from the start, been to find cause to impeach Trump. To that end, there should be little doubt that, should the Senate go Democrat this year, we will see that process begin. Whether the cause if "he spit on the sidewalk" or "he's been confirmed as a Russian spy" is immaterial. The Democrats, along with their Republican allies in the NeverTrump movement, will not stop in their quest to cleanse the White House of an uninvited guest from the unwashed class rather than the enlightened Political class.

Constitutionally Mueller can't indict the president. But like you stated, he can come up with something to hand the Democrats to start impeachment hearings if the Democrats gain the House. But like I stated in another thread, I don't see a blue wave occurring. And I would bet money that Republicans will gain seats in the Senate.

No matter how much establishment Republicans, Never Trumpers, hate Trump, they despise Pelosi more.
 
1. Mueller has a grand jury. If he could indict...he would and could. He can't indict. Sorry.

2. The Senate can do whatever they want, but they can't indict, either. Sorry.

3. Nobody has any evidence...that we know of...that Trump had anything to do with Russians regarding the election. shrug...

4. Trump hasn't tried to obstruct any investigation...not at all. In fact, he's been quite cooperative. Sorry.

Need you be reminded this is a counter-intelligence investigation that is investigating Russia's successful information attack on the United states in an effort to keep Hillary from being elected, and to get Trump elected. That it's tied in 100 ways to Trump, but he cannot be indicted, says nothing about what he did, and how he covered it up, and if he obstructed justice, if he broke other laws, and if his team was violating the law, etc., etc., etc.

I'll agree that the reactionary folks that don't like Trump have been counterproductive to the cause, overall.

We don't need hysteria to know Trump's history, and that (to my eyes) tells us everything we do need to know.

So this was according to Giuliani. Not saying Mueller has any intention of seeking an indictment against Trump (he almost certainly won't), but it's doubtful that conversation happened.

You forget that there are plenty of other people to indict besides the President. Don Jr. and Jared come to mind as well as the obvious like Cohen. And before you say it, if Trump pardons them he will be guilty of abuse of power another impeachable offense. that the Democratic controlled House will find very interesting.

Not indicting a sitting President is a tradition. It's not specifically spelled out in the Constitution that you cannot do so. Indicting a sitting President remains to to this day an untested theory.
