I thought we were posting about legal precedents that helped to create the federal same sex marriage law. Guess I was wrong. One of the first pieces of legislation that paved the way for same sex marriage was the decision by the judge in Hawaii in 1996.

Right. Wasn't a piece of legislation. The banning of the same-sex marriage ban was a decree by a judge in Hawaii.

Hawaii didn't help create the federal same sex marriage law. What is it you don't understand? Hawaii didn't make same sex legal in 1996, and they weren't the first state to legalize gay marriage. Massachusetts was - in 2004.

For example, how do you suppose the gay marriage provision went through each state like a freight train? Because a clear majority thought gays should be married? No. Because a long time ago some judge in, I think, Hawaii, ruled gays should be married and established that legal precedent.

If federal district court judge Ellis rules the discovery of Manafort is unconstitutional, that puts the discovery of Flynn and every other Trump associate in the Mueller investigation in jeopardy because of legal precedents.

I actually think it is you that does not understand legal precedent. The description you set forth is not the way it works. It depends on the specifics of a judges ruling as to how far its ramifications. In this case, there are not broad constitutional issues at play. Manafort is challenging SOME of the evidence, which could disqualify that evidence. No broad issue there. The Manafort case is very specific. The judge would have a specific ruling.

Manafort is also challenging the authority of Mueller. But, that question did not go well in a similar challenge in the DC circuit. The judge in the DC case shot Manafort's petition out of the water in a rather scathing way. It MAY (and likely) will be foundational (a precedent), as you can bet the government lawyers will be arguing the DC ruling in front of the Virginia judge. However, the Virginia judge will make his own decision as District Courts often see things differently, which is why we have a SCOTUS. Most likely, however, if Virginia throws the case out (possible), the DC case will proceed on its own.
