Fresno State says it can’t discipline the professor who called Barbara Bush an ‘amazing racist’

School officials said they were reviewing the tenured professor’s position, and Castro rebuked Jarrar, saying her remarks left him “shocked, upset, appalled just like everybody else.”
On Tuesday, Castro announced what the university would do about Jarrar’s words:
Nothing.
“Professor Jarrar’s conduct was insensitive, inappropriate and an embarrassment to the university,” he wrote in a five-paragraph statement. “I know her comments have angered many in our community and impacted our students.”

The university, Castro said, “carefully reviewed the facts and consulted with [lawyers] to determine whether we could take disciplinary action. … We have concluded that Professor Jarrar did not violate any CSU or university policies and that she was acting in a private capacity and speaking about a public matter on her personal Twitter account. Her comments, although disgraceful, are protected free speech under the First Amendment of the U.S. Constitution.”

Personally, I tend to think this is a good thing, protecting 1st Amendment rights.

And apparently the school rules do not provide for any penalties for this action.

TAMPA — A tweet suggesting that the devastation of Hurricane Harvey was "instant karma" for the red state of Texas has cost a University of Tampa professor his job — making him just the latest academic fired for off-duty speech.

The University first distanced itself from sociology professor Kenneth L. Storey on Monday. But a tide of online outrage continued. A #FireKenStorey hashtag spread far beyond the university. Angry Facebook comments piled up.

"Don't think this is a school we will be looking at for my daughter anymore," one commenter said. An alumnus wrote, "Good thing I already paid you, because I'll never send the school another dime again."

On Tuesday morning, the university fired him.

Fresno may respect her right to free speech, but donors won't.
 
It sounded more like "we checked, and she didn't break any rules...damnit".

If I were a Fresno state prof I'd say controversial stuff and give out suicide hotline numbers, since that's LOL acceptable and in the rules

I mean for someone who use to say how much people should not get offended by everything, that one professor at one university really has you triggered eh.

One of the things that Jarrar was referring to is that she took issue with the Bush family’s legacy in Iraq and said that history can’t turn a blind eye to Barbara Bush’s critical comments about Anita Hill and her remarks that underprivileged Hurricane Katrina evacuees were “better off” sheltering in the Houston Astrodome. I personally remember when Barbara made the Katrina Astrodome comments. I lost a lot of respect for her at that point.

Jarrar, on her personal twitter account, said things not even close to what right wing white male pundits say daily. But, she is female and Muslim. She has received threats and many venomous comments for her free speech.
 
I actually find it troubling that they sought legal counseling to see if she could be fired. If it came out she was saying stuff like that in class as a teacher then I would have an issue, however simply tweeting something stupid shouldn't be a fireable offense.

Agree, and of course, it all depends on the university's code of conduct policy for tenured employees. They've already eluded that while they will not condone her comments, she was doing it on her own time.
 
BS, she called for the death of people and ensighted violence in an interview, she should have been arrested.

I support the university in their choice just like I did when that West Virginia women got her job back after the ape in high heels comments.

People have the right to say whatever stupid things they want. Unless it is done on behalf of an employer they shouldn't be able to reprimand them for making the comment.

I have no respect for either of these people but respect their right to free speech.

Uh?....Ted has called for all kinds of crazy stuff...But he is a private citizen....Still he had the secret service check him out for his crazy comments on President Obama...But he wasn't arrested...First amendment I guess

I can't comment on what I didn't hear/read, if he called for Obama or anyone to be shot he should have gotten arrested.

What does her religion have to do with this?
 
I bet they "could" if he said something bad about Obama, Clinton, Sharpton, or Jackson and no one would worry one damn bit about protecting the 1st Amendment.
Well, they still could now, but if the school rules don't cover it, the employee in question might sue.

I tend to agree. She may work for the university, but her comments were made by herself as an individual and not as a university spokesperson. They were inappropriate, but so what? She has the right to say what she thinks just like anyone else. I've always went by the old adage which seems to apply less and less these days of, "I may disagree with what you say, but I'll defend your right to say it."
 
Of coarse Jarrar's religion had nothing to do with her comments, but I'm sure it didn't help the hate mail she received.

I don't know if Nugent was punished sufficiently, but Kathy Griffin was put on the "no fly" list for as while, and her career in comedy was devastated.
