Cohen Under Criminal Investigation

Lawyers for Michael Cohen, personal lawyer to Donald Trump, argued in a hearing today that a recent FBI raid on his offices swept up sensitive documents that should be protected by client-attorney privilege. The Southern District of New York (SDNY) has an interesting counterargument: Cohen is barely a practicing lawyer, anyway—which they claim to know because they’ve been reading his emails.

In 2014, a mysterious buyer using a limited liability company that hid the purchaser’s identity paid $10 million in cash for a small apartment building on New York’s lower east side that Cohen had purchased just three years before for $2 million. The handsome appreciation came despite the fact that the assessed value of the property, at 172 Rivington St., hardly budged in these years, hovering around the price Cohen paid for it.

Three other properties Cohen bought and sold in roughly the same time frame followed a similar pattern. Each was purchased by a different LLC, but were tied together by the fact that a lawyer, Herbert Chaves, served as the LLCs’ manager.

Any high power lawyer who has ever done some legally iffy things, which is probably near all of them, isn’t going to want to touch Trump with a 10 foot pole.

I never said there was. That's kind of the point of the investigation -to find out if Trump did commit a crime. You have a hard time following debates, don't you?

We'll see what shakes out. But he surrounds himself with criminals, and I believe birds of feather flock together.

But yes, my gut says if Trump don't go down for something federal, his time will come at the hands of the People of New York.

Making it harder for someone to get counsel through intimidation is a nasty tactic. It won't sit well with a lot of people.
 
The earliest reports on the Cohen raid mentioned dealings with the stripper and some video recordings where Trump mentioned [female genital] grabbing, its is difficult for me to relate these to Russian collusion. Now we are getting leaks on Cohen selling immensely appreciated real estate with the suggestion of "money laundering" and I still am at a loss on the relationship to the subject of Mueller's commission. What is becoming evident is that the leakage is part of Mueller's methodology and when it comes to privileged attorney communications this is especially troublesome.

I get the impression Mueller is still searching for evidence of Trump's collusion with Russia to defeat Hillary and that now he's trying to find anyone who worked with or for Trump that will turn over evidence, they've investigated Russian oligarchs who bought Trump condos, pored over financial statements and regulatory filings on casino resort developments, subpoenaed dozens of banking records from several financial institutions some 'suspects' dealt with, used any discrepancies with tax filings or other transactional records to extract 'confessions' of misrepresentation, but no admission of a conspiracy to collude with Russia yet. I think there is not just no evidence of collusion, but that there in fact never was any collusion with Russia by Trump (or any of his associates).

Trump has a long history of real estate development, dealings (and lawsuits) with construction contractors, complicated regulatory compliance submissions in numerous intricate casino and resort projects, plenty of aggrieved creditors in bankruptcy filings, he's got all sorts of disgruntled 'apprentices' from his TV shows, strippers, porn stars and pole dancers animated by this unsubstantiated "Me Too" 'movement', and they all provide a big cohort of potential witnesses to grieve over his past dealings, some of which have unsuccessfully litigated against him and would be glad to get another shot -but apparently none have actionable evidence of Trump's collusion with Russia to defeat Hillary.

I think Mueller is going to have problems with Cohen, that Mueller isn't going to get any evidence of collusion from him either and that in the process Mueller's credibility will be irreparably harmed.

It tells the whole country that there's a massive abuse of power that's being used to defacto overthrow a duly elected president. It's a threat to our democratic process.

Abuse of power? Trump hired incompetent lawyers and then ignores everything his lawyers tell him anyway. This causes other lawyers to stay away, they don't want to deal with a client like that. That's his own doing.

As far as "defacto overthrow," the process is called impeachment and it's a constitutional process. If he gets a majority vote in the house and a 2/3 vote in the senate to convict, that's a duly-enacted Congressional power. Weird how the constitution stops mattering to you when the outcome is something you might not like :lamo

The real threat to democracy is a conman convincing right-wingers like yourself that the president is above the law.

True, but I’m not sure what the ethical thing here is. If they uncovered evidence of Cohen commiting crimes are they supposed to ignore it out of fear that it will have a chilling effect on other lawyers with something to hide from taking Trump as a client? Should lawyers be able to participate in crimes without fear of repercussions?

He was already cooperating. When you change tactics and do a no knock raid to violate lawyer client privilege that shows an overzealousness that most in DC don't have the stomach for.

You do know that although Mueller uncovered a lot of the evidence that caused the raid, it was out of his mandate, so he gave that evidence to Rodstein, who passed it on to someone else to handle. So, other than finding the initial information, the actions were not Muellers.
