The Minneapolis police officer who fatally shot an Australian woman in July was charged with murder Tuesday after he turned himself in when a warrant was issued for his arrest.

Officer Mohamed Noor turned himself in on Tuesday in connection to the 2017 death of Justine Ruszczyk Damond. his attorney confirmed.

murder/3rd degree, manslaughter, state does not have to demonstrate 'intent' for either charge = appropriately charged

I've got no problem with him being charged. He's probably good for negligent homicide.

If i recall, both officers (this Noor guy and his partner) did not have their BCs on.
And weren't there past issues regarding this cop too?
 
I'm not going to bother confirming that they are right. That would take work, since they're speaking about a statute and one case, not an entire body of cases with similar issues. Buuut:





Minnesota's third degree murder statute reads: “Whoever, without intent…causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life…” But what is a depraved mind or heart? An opinion cited in a Maryland appeals court case, Debettencourt v. State, said a depraved mind involves "a knowingly dangerous act with reckless and wanton unconcern and indifference as to whether anyone is harmed or not." It was also described as "a state of mind just as blameworthy, just as anti-social… just as truly murderous as the specific intents to kill..."

A couple weeks ago, a grand jury indicted Eric Coleman for third degree murder, who was allegedly drunk on a snowmobile when he killed an eight-year-old boy. The charge was used years ago against Stephen Bailey, who called himself the true master and suffocated a man during a sadomasochistic sex act. In the end, prosecutors had to settle for second degree manslaughter, death by someone's culpable negligence, which is a secondary charge Noor faces as well. "I think what we're saying in this charge is that Officer Noor did not act reasonably, did not act objectively reasonably and abused his authority to use deadly force,” said Freeman.

On local television news HCDA Mike Freeman stated his opinion was the fact that Noor drew his service firearm while seated in the passenger seat, fired across/in front of/in the face of his partner seated in the driver seat, Noor NOT knowing what he was actually shooting at, demonstrates the 'depraved' aspect of the charge.

correct; BCs were both off & Noor has multiple previous complaints made by females ..........

he prolly has a woman problem, or sumpin' ...........
 
there is already case & appeals precedence to back the charge

1. The burden of proof still applies.

2. You're wrong when you say 3rd degree murder/manslaughter doesn't require intent. Any murder charge requires intent.
