FORT WORTH, Texas -- An appeals court has ordered a new trial for a man whom a judge, impatient with the defendant's disruptions, ordered to be jolted several times with 50,000 volts from a shock belt. The 8th Texas Court of Appeals in El Paso ordered the new trial for Terry Lee Morris. He was convicted in 2014 of soliciting a sexual performance from an underage girl. The court ruled that state District Judge George Gallagher of Tarrant County violated Morris' civil rights when he ordered a bailiff, on three occasions, to shock Morris as punishment for not giving proper answers to Gallagher's questions. Shock belts are placed on defendants' legs. The appeals court said they are to be used only if a defendant becomes violent, not to enforce decorum. "While the trial court's frustration with an obstreperous defendant is understandable, the judge's disproportionate response is not. We do not believe that trial judges can use stun belts to enforce decorum," Justice Yvonne T. Rodriguez wrote in the appeal court's ruling, according to the Fort Worth Star-Telegram. Gallagher declined to comment to the Star-Telegram.

Give the defendant Terry Morris a new trial in a different Texas circuit.

Clearly the judge was wrong, if the behavior didn't change, then it would certainly help a mental health defense.

I just sent the Tarrant County website a request for the judge to be disbarred & the bailiff to be fired .............

I think we should all do the same. I just read the long version of this story, and it wasn't pretty.

Now one of the attorneys is trying to deny the shock belt was even plugged in. Insane.

Sounds like they needed him to answer questions. Can't do that from outside the court room. Should have thrown his ass back in a holding cell with Bubba and took a break.

WTF? The fact that one crime or injustice occurred does not excuse another. If that trial was rendered invalid then trying him again is not double jeopardy - ordering re-trials has been done before. It is not the fault of the victim that the judge assigned to hear the state's case acted improperly.

Judge and Bailiff broke the law. But nothing will happen.

Something did happen, the verdict was set aside/destroyed.

Now a new trial has to be held, everybody has to re-take the stand, the victim gets victimized again but this time by some stupid ass judge and a moronic fool who did the actual shocking of the prisoner.

Now the poor girl has to go through the entire process of a trial again because some dumbass judge went too far and shocked the suspect.

This judge needs to be struck off and removed from the bench forever and ever.
