Ok. So there were no idiots doing idiotic things before Trump? Charlottesville was different because the accusation is Trump has emboldened racists, because he is a racist.

Was the judge a racist? Does Trump approve of shocking people like that? Is that how the judge is emboldened?

It just makes people look silly to bring up and blame Trump for something so unrelated to him.

My guess is that the judge wanted to keep things moving. The guy was holding up the trial and the judge decided to choose a more expedient method of coercion than cooling his heels in lock up. That just amounted to avoidance for the defendant...not compliance.

He has a right to claim the fifth and yes, they can do a video teleconference to a room where he would be kept. There was no need for this and the judge and bailiff should be reprimanded and/or fired. They had a clear precedence of when to use the shock belt (i.e. defendant being violent) and just used it because they were annoyed. If I used shock treatment against everyone I found annoying someone's electric bill would go up.

The Appeals Court acted correctly in overturning the verdict and ordering a new trial.

The Judge acted incorrectly in ordering the shocking and should be disciplined.

The Sheriff acted incorrectly in carrying out an order that they knew (or ought reasonably to have known) was illegal and should be disciplined.

The fact that the Victim has to undergo the stresses involved in a second trial cannot be blamed on the Defendant, but only on the Judge and Sheriff.

A sharp lawyer could advance a case that the Victim suffered severe emotional trauma because of the illegal acts of the Defendant Judge and Defendant Sheriff when they knew, or ought reasonably to have known, that their actions were likely to cause the vacating of the original trial process and thereby require the Plaintiff Victim to have to undergo the emotional stresses of a second trial. (Don't be surprised if a Statement of Claim to that effect is already in the process of being drawn up. [Don't be surprised to see the State of Texas and the County where the trial was held being added as defendants on the basis that "the Principal is liable for the acts of their Agents.])
 
Something did happen, the verdict was set aside/destroyed.

Now a new trial has to be held, everybody has to re-take the stand, the victim gets victimized again but this time by some stupid ass judge and a moronic fool who did the actual shocking of the prisoner.

Now the poor girl has to go through the entire process of a trial again because some dumbass judge went too far and shocked the suspect.

This judge needs to be struck off and removed from the bench forever and ever.

This judge has a long history of being an ass, but no one runs against him so he continues to be elected. They need to get rid of him asap.

This story was very distressing to read! Why does it seem that lately we are trying to mimic another bad habit common in a third world country! That's not us! If the man had died from being repeatedly shocked, is the judge a murderer, or an accomplice, or how would they explain it? :afraid:

It should be a mistrial with the prosecution deciding on a new one... after the judge and bailiff are jailed awaiting their trials.

Yeah, it is disgraceful that it took 4 years to expose the behavior of the judge and it should not be possible for judges who get removed for dereliction of duty/disgracing the office of judges to be reelected, such people should be automatically disqualified.

That is the truth, we do not have elected judges, people here are chosen to uphold the law and decide guilt/innocence and the appropriate punishment if found guilty. They should not be or act like politicians who have to be brutish to carry favor with people who are more interested in an eye for an eye than giving the appropriate punishment.

Yep. I never understood electing either judges or sheriffs. Both positions should be filled via an objective system that puts the most qualified person into the position. Basically, start with a list of minimum requirements that must be met in order to even get on the list of candidates and then start weeding out people based on things like depth of training/education, experience, accuracy in judgement, etc. until you have the best candidate possible.

Sad but I can say I do not think it would happen in my country. If it did, Judge would be removed and whoever else was involved in would be charged and sued.

What is wrong with conservatives these days? When I was young, conservatism meant something. Conservatives of yesteryear believed that torturing prisoners was only what the Communists did. It's repugnant that we are even debating the merits of torture.
