Sure, now we know...but we didn't know about it in October 2016 just before the election.
 
Agreed. Her cashing the check proves he performed his side of the agreement. Performance is proof of the existence of a contract. But does it matter? This "hushed up affair" is all over the news. The world even knows there are "images" and "video" that document it. It's fairly hilarious. The declaratory judgment action by Daniels lawyer was a brilliant stroke, and has made Cohen look like an utter fool for having started his arbitration proceeding. Trump must be seething at him.

Her cashing the check proves that she agreed to the contract regardless of whether Trump signed it or not. But since the money was wired to her lawyer she might not have cashed or spent it.

Agreed, the declaratory statement in the lawsuit was an interesting move...and kinda blows the confidentiality agreement out of the water. lol

But Cohen himself broke the agreement first, when he admitted to the media that he wired her the hush money.

I think you are absolutely right. She signed the agreement and cashed the check. Trump really didn't even have to participate in the contract.

My theory is she's trying to get the court to void the agreement to free her up to do a book/movie deal.

I'm not sure Cohen did -- I'd be surprised if he was bound by the agreement with her.
