First Amendment certainly applies in this case. It is still quite distasteful, though.

So what do you think? First Amendment or arrest? Answer the poll.

EDIT: About the question in my poll. I'm a bass player. We are all retarded.

My first thought was, "That Sheriff needs to brush up on his constitutional law and butt the hell out of things that aren't criminal matters'.

That, and his mealy-mouthed excuse for having butted in in the first place is incredibly weak.

He's got that orange glow goin' on, but Trump's not even that hot.

Public profanity is not cool. It's randomly aggressive and attention whoring. I wonder how the driver would feel about someone going to his kid's playground and yelling **** repeatedly. Maybe someone should yell **** at his wife everywhere she goes.

I don't think it's appropriate to have the F word that public.

They should change the wording for sure.

It's vulgar. Crass. Inappropriate. Generally speaking, it's very Trump-like in it's mentality.

Shouldn't we all strive for something better than that?

Just because you can, doesn't mean you should.

Since when do you care about the constitution anyway?

Let him drive around and deal with any consequences if any at all.

He has the right to say what he wants even if you do not agree.

Well yeah, but it's Texas. The thought that liberals exist is offensive to them.

1st Amendment.....let it stay.

Public profanity is against the law.

If someone sees his wife get out of that truck, they could follow her yelling ****. See how he likes that. If he gets aggressive about it, shoot him.

No arrest
But also no first admentment

If it actual says and spells out the whole F word that can be removed and or you can be fined for profanity like that and rightfully so. Especially that word displayed in public for all to see including minors.

If it just said F or F with some stars etc then it would be fine but in many areas (possibly all i dont know) i bet there are laws, ordinances etc that regulate the use of that word for public display.

Don't get personal like a douche. I'm saying it could happen. He's asking for it. If he wants to engage in public profanity, he can't complain about it.

If we keep lowering the bar as to what's publicly acceptable, how low do we go?

Public profanity is not protected speech.

Profanity is always a matter of perspective......It does not offend me.

And really? I don't care one way or the other if snowflakes are offended or not.

You don't decide law. It's against the law. It's not protected speech.

How would you feel about someone yelling **** at your wife in public? He's yelling **** at everyone, women and children included.

Actually....at least one State Supreme court has ruled that profanity IS protected speech.

More to the point, if you are that offended, dont look.

Comparing a statement on a window sticker to someone actively following another person around yelling at them is apples and oranges.

Stupid.

Public profanity. Okay, don't follow, just yell **** at her everytime she gets out of the vehicle. Got a problem with that?

Cohen v. California, 403 U.S. 15 (1971), was a United States Supreme Court case dealing with freedom of speech. The Court overturned a man's conviction for the crime of disturbing the peace for wearing a jacket in the public corridors of a courthouse that displayed the phrase, "F*** the Draft".

"In a dissenting opinion, Justice Harry Blackmun, joined by Burger and Black, suggested that Cohen's wearing of the jacket in the courthouse was not speech but conduct (an "absurd and immature antic") and therefore not protected by the First Amendment.[5]"

I am glad they feel the freedom to express their views. Gone are the obama years where the weaponized IRS would target individuals and groups in political disagreement out of hand.
