How many 9th circuit opinions were affirmed by SCOTUS. It is quite possible for the 9th to be simultaneously the most reversed and the most affirmed circuit if the number of cases involved is high enough. That's why it is more informative to look at percentages as opposed to raw numbers.

The Ninth Circuit and all of the Federal Circuits have not just two outcomes possible when their decisions are before the Supremes.

They can be Affirmed, Vacated or Reversed. Only "Affirmed" is a good one for the lower court. If it was a pass in football, they are roughly parallel to complete, incomplete or intercepted.

In the case of the Ninth for the 10 years ended 2008, their stats were 35, 33 and 107. That's 35 complete, 33 incomplete and 107 intercepted. A 20% Affirmation rate.

The Sixth also has a dismal record: 19, 6 and 45. A 27% affirmation rate.

The Fifth is also an embarrassment at 14, 4 and 33. a 27% affirmation rate.

Checking a decade of results from all of the Circuits, the Ninth shows a wide lead posted and it will take years for any other team to catch up. They are the preeminent incompetents. Your position should not be to defend their incompetence to try to figure out why they are incompetent. Which country's Constitution do you suppose they are using to make their decisions?

Woody Hayes said about Passing that when the Buckeyes threw the ball, "three things could happen and two of them were bad". By that standard, the Ninth has more bad things happen than any other Circuit.

That is defined by legislation, the Congress.
