“That’s why we must do better because the current approach isn’t working,” she said. “Washington has burdened schools with increasingly elaborate and confusing guidelines that even lawyers find difficult to understand and navigate.”

DeVos claimed the current system has led to hundreds of cases in the department’s Office of Civil Rights mostly filed by students who reported sexual misconduct and believed their schools let them down. But she said the system has also generated dozens of lawsuits by students punished for sexual misconduct, who also believe their schools let them down.

DeVos said any school that fails to take a report of sexual assault seriously commits discrimination but added that a school that uses a biased system toward finding someone guilty of sexual assault also commits discrimination.
Failing to take action on an alleged sexual assault is not discrimination. Really. Money bought her way into cabinet.
Let the Police look after it. It is a felony.
She is a real piece of work.
 
I'm not really seeing a problem with what she said. But I also haven't seen what actual changes to the guidance she wants to make.

She is partially undoing something that should be even more offensive to you, if you think it should be a police matter rather than a campus matter (which I tend to agree with).

The Title IX rules promulgated under Obama have made campuses into sexual assault star chambers where due process is scant. She at least wants to restore some of that.

THIS is her problem, and what's encouraged under current Title IX rules:

that a school that uses a biased system toward finding someone guilty of sexual assault also commits discrimination.

She's walking that back some.

I agree, in regard to the actual rape. But you still end up in situations with an alleged rapist and alleged rape victim living in the same dorm and attending the same classes. It isn't unreasonable for colleges to take steps of their own to minimize the trauma that might inflict.

Sexual assault allegations off campus are reported to the Police. Or do you head to your nearest University?
 
I'm not sure exactly what she meant but my interpretation is this:

If a school refuses to take a statement about an alleged assault they are discriminating against the person for not believing them. The other extreme would be s school who takes the approach of anyone accused is guilty until proven innocent and is treated as such is discriminating against the alleged accuser.

She is removing Title 10- Not requiring Universities-Colleges to have the Police handle them. I disagree vehemently with the previous rules under Obama.

Then enforce separation of the 2 or whoever is involved. This is purely a legal matter

The last I checked, Sexual Assault was Legally a Crime and not Scholastic Crime.

Not without having the authorities involved. They are not qualified to investigate. That could have been addressed as well
