Bill Cosby judge declares mistrial; prosecutor vows to retry case

Does anyone know if the jury being deprived of their right to speak is common?

This is so very wrong, maybe Mrs Cosby is right that this judge is bad...
Since they're going to retry, letting the jury speak might influence the next trial.

Makes sense not to let them.

Wherever there is an injustice, there are a slew of righties and wackos defending it.

From USA Today:

NORRISTOWN, Pa — The jury in Bill Cosby’s sexual assault trial here declared itself still hopelessly deadlocked on Saturday and Judge Steven O'Neill declared a mistrial.

O'Neill polled each of the 12 jurors whether they believe “there is a hopeless deadlock, which cannot be resolved by further deliberations?” Each juror stood and answered yes.

Cosby lead defense attorney Brian McMonagle then motioned for a mistrial, which O’Neill promptly granted.
District Attorney Kevin Steele told the judge he intends to retry the case.O'Neill released Cosby on the same conditions of his $1 million bond posted in December 2015. https://www.usatoday.com/story/life/people/2017/06/17/cosby-trial-judge-declares-mistrial/102830524/

The deliberations lasted longer, I think, than the trial itself. I'm sorry that the case will have to be retried, but the jurors did their honorable best.

Are there degrees of consciousness?

Is there such a thing as impaired consciousness?

Are there degrees of impairment of consciousness?

Were mixed emotions involved?

If there was a desire present, to please Cosby, how would the balance of permission vs. displeasure, be quantified?

Ohferchristsake. What's the definition of 'is'?

I suspect that she knows better than all of us how twisted Bill is, and knows as well that he would never take it "too far" because he lives by a code, he honors that code.

Lives by a "code"? I guess that may be okay for vagina penetration but no kissing on the lips.

UNCONSCIOUSNESS MAKES CONSENT IMPOSSIBLE. DRUGGING SOMEONE INTO UNCONSCIOUSNESS AND HAVING SEX WITH THEM IS RAPE

There's no balance. This is black and white.

Constand testified that she was conscious of what Bill was doing, but was unable to move her hands or legs, to reject his advances.

So Constand was not completely unconscious.

“I wanted it to stop,” she said, blinking back tears. “In my head I was trying to get my hands to move or my legs to move but I was frozen and those messages didn’t get there. And I was very limp. And so I wasn’t able to fight him in any way.”

There was no rape, but maybe sexual assault.

A retrial in this case is no longer prosecution -- it becomes persecution.

It's only rape if they're unconcious? GTFO of here with that nonsense.

Especially when the DA ran for the job on the platform of getting Cosby.

What drug would that be that would cause all that...assuming of course that she was telling the truth?

This is what the state needs to explain.

Amoungst other things.

Reality should effect trials.

Argument rejected.

I dont know his code but I am very sure she does.. these people are both extremely smart and extremely close.

Constand stated that she made no verbal or physical attempts to let Cosby know she was rejecting his advances. Her excuse is not total unconsciousness, but rather altered consciousness.

The prosecutor's witness was pretty bad , all the communications back and forward between the two will make one wonder .

It always makes me nervous to try old, stale cases with no on-the-spot indications a crime was committed. Personally, I don't think the prosecution should be able to bring charges on these kinds of cases after a year has passed.

I don't know Maggie. Many rape cases go cold, often because of the backlog of DNA analysis. Should rape victims not have their day in court if possible? If cases just sit there, we owe it to the victims to determine why.
Of course if they don't report a crime until many years have passed, than I completely agree with you.

What you have just described is definitely rape.

How many sex criminals do you want walking around?

Fill us in.

An 80 year old male sex criminal is an example of an oxymoron IMO. He is no threat to society, and putting him in jail is just a waste of tax dollars.

Your opinion is out of touch with reality.Bill Cosby is close to 80 (He's 79 years old.)And he's likely to spend the rest of his life in prison after he's found guilty of the sex crime he's charged with.

People like him should be locked up after they're found guilty.

His crimes were committed when he was younger. If he is guilty of sex crimes, why should he get a pass because of his age?

Because it would serve no valid purpose to society to put him in prison.

So to be precise, I'm not at all against a conviction. I would bet my last dollar that he is guilty as charged. And had he been caught while he was still active, I would not object to a prison term. IMO, in those days he was just a typical horny young male with money, but not really any sort of predator to society. He did not kidnap any of those women--they were with him voluntarily.

My position is that society can punish a person, an offender, by means OTHER THAN a prison sentence, and in this case the tax payers would be better served by some other form of punishment.
