Former National Security Adviser Michael Flynn will invoke his Fifth Amendment protection against self-incrimination as he notifies a Senate panel that he won't hand over documents in the probe into Russia's meddling in the 2016 election, according to a person with direct knowledge of the matter. Legal experts have said Flynn was unlikely to turn over the personal documents without immunity because he would be waiving some of his constitutional protections by doing so. Flynn has previously sought immunity from "unfair prosecution" to cooperate with the committee.
Neither the Senate nor the House Congressional committees investigating Trump/Russia collusion should either offer or grant Flynn immunity. Doing so would hamper the investigation/prosecution of Special Counsel Richard Mueller. Congressional immunity is why a court overturned Oliver North's three felony convictions related to the Iran-Contra political scandal. If Flynn doesn't cooperate with the DoJ/FBI, Mueller should prosecute Flynn to the fullest extent of the law and see to it that Flynn's generous military pension is forfeited for violating the rules of his retirement.
 
If I was Flynn I'd invoke the 5th if someone so much as asked me my date of birth. The Democrats are out to lynch him no matter what so keeping his yap shut is really the ONLY option he has.

The filth is a very important right. It is very possible to say something self-incriminating without knowing it. Our founding fathers knew this. Too bad the Bubble-people don't.

If someone offers immunity and it is not accepted that usually means that they don't have any juicy info OR that the prosecution has enough on them without having to give immunity.
Just so you know how this works immunity is almost always asked for and given when someone who is not being investigated... as in Hillary's crew of advisers or whatever.
Flynn could go to the prosecutor and say he has something on someone higher than himself and the prosecutor would ask him what and who-- all theoretically/hypothetically -- and the prosecutors could trade immunity for it. It is a tightrope to walk.

Most likely that is a starting point for negotiation. I suspect they are NOT going to let him off free as a bird and there will be a demand for some jail time but Flynn will get a reduced sentence at a country club facility. In return Flynn gives up ________________________.

I don't know. To make a deal you have to hand over something bigger than himself. His has the potential to be pretty big. Which is why I'm thinking they shot down his begging for immunity.

You could be 100% right on this. Or he might feel he can help them convict a bunch of others on this level or even lower.

However, Flynn - for all his faults and mistakes and greed - is not a stupid man and he knows just what you just said about being able to make deal for immunity. And he still publicly had his lawyer come out and indicate he is open. So Flynn obviously knows the drill and still asks anyway ..... which tells me that he does indeed have a bigger fish to offer than himself. At least in theory.

We can only hope.

In Machiavellian fashion, Trump has a history of choosing an Opportunistic Strategy over a Principled one. When Trump's opponents have used the 5th, he has no problem suggesting their guilt. When it benefits Trump, the 5th has proved useful.

He may choose not to testify, but I believe his records can be seized. But then again, so could Lois Learners, so let's see how equal justice under the law works where republicans are concerned.

It's not about Flynn anyway, but the bigger fish. Just as with Lewinsky, they should offer immunity IF Flynn has the smoking gun on Trump's collusion. But i doubt it. There's plenty other evidence out there
 
Taking the 5th is always a legit option. Guilt or innocence is irrelevant.

That is true, the fifth was there to prevent people from self incriminating themselves. Flynn already has evidence piling up against himself, and no person with any legal knowledge would legally self incriminate themselves. Basically if they had enough evidence to lock him up, and his testimony would incriminate him, why would he say anything that could add to his sentance or even his list of crimes?

Let their trumpistani deflection syndrome flow. Tape on trump and Flynn before the election on the 5th and right now will make great ad fodder in every election, even the specials and off years, before the 2020 POTUS .

flynn can go to hell. He's a disgrace to the uniform he used to wear. And all the while since being fired trump's been calling him. It always comes back to flynn.

flynn lynched himself; trump/flynn attacks on the media and alphabet agencies have backfired; may this destroy the GOP with their monstrous legislative agenda
 
Flynn is well up a creek without a paddle.
Although I can say that pleading the 5th will get him what he wants which is immunity.

Although that won't help him against something else that may come up.
