I don't think lack of intent was invented, but to take down a candidate for the presidency who let 4 emails slip by was not grounds for criminal offense and no harm was done. He was between a rock and a hard place. It had no affect on the election as I said before IMO

I know what they are thinking. Comey made up the memo to get Trump. The problem with that is that the Former FBI director was known for his impeccable note-taking. They would have to find at least 50 lies and made up memos just so that they can give credibility to this new conspiracy theory that came out of their camp in the first place.
The one who does that is Trump, not Comey.

He is imploding at an alarming rate. I suspect he will be on his best behavior while on the overseas visit, he should enjoy it. At his current rate, he will not be doing a second one as CIC.
Perhaps not 'lack of intent' itself, but applying to the situation of Hillary's highly classified emails on her private email server, freely distributed to people without the proper security clearances, that is certainly an invention of Comey's (or maybe Lynch put him up to it to she wouldn't have to). Taken in contrast the case of US Navy sailor Kristian Saucier who is jailed for 1 year for taking a few candid photos of himself on his sub, which never left his phone, which he destroyed without any distribution.

Justice Department doesn't rely on Comey to tell them what the evidence shows, they look at what the evidence tells them. If they have the memos, it's their call, not Comey's. So Comey likely just "got that one wrong". No lie needed.
