Trump Tweet Suggests His Conversations With Comey Might Have Been Recorded

From what I understand, it's legal to record. But if there is questions, they can be subpeanoed as a matter of being public record. Now, with regards to how they record, I don't know if there are standards within the Presidential Records Act that prohibit certain ways of recording or do they have to be open and up front about it with whom they record?... That I'm not sure.

Thanks Rob....Someone in here pointed out that every President since FDR has recorded WH meetings, and calls..Other than Clinton....But, that would lead me to believe that certain "one party" laws don't apply in the WH.

It's perfectly legal.

First, Washington DC is a one-party consent state. That means you don't need consent to tape a conversation. In some states you do, in DC you don't. So anyone can tape anyone on the phone.

Second, even if it were illegal, the President couldn't be charged with a crime without first being impeached. Good luck with that.

I agree. Trump is his own worst enemy. I just couldn't believe his Twitterstorm last week including Rosie O'Donnell. It's called "gravitas," Mr. President.
 
I don't think Comey was recorded at all. I think Trump said that because he realizes how similar things are turning out between his presidency and Nixon's. So, he makes this crazy Tweet perhaps as one-part humor, one-part throwing folks off balance.

Not that I'm defending him. I just don't think such recording exist. But on the off chance that Pres. Trump has been recording conversations that take place in the White House but no recording of Comey declaring that the President isn't under investigation exist, this will only add fuel to the speculative fire concerning collusion with Russia. So, in a way Trump's statement could end up backfire on him. He might have been better off keeping his mouth shut (which we all know is virtually impossible for the man).
 
Sean Spicer was asked again today about if the White House will either confirm or deny that conversations in the White House are recorded. Spicer's response - at least three times - was to say "The president has said all he intends to say on this." The press is asking because Trump himself put the possibility of secret White House tape-recordings in the public domain:

According to different sources, Trump did indeed secretly tape record conversations at Trump Tower. With Spicer's answer, a few scenarios are possible. (1) Trump is using ambiguity as a coercive tool. Trump bluffed and no White House tapes exist. Trumps tweet was a sophomoric public attempt to bully Mr. Comey that will yield disastrous consequences for the president. You can bet that the Emir of the UAE, who visited the White House this morning, uttered absolutely nothing in the Trump White House beyond pro-forma niceties. This is how it will be from now on whenever US officials, military officers, US legislators, and foreign dignitaries visit with Trump anywhere on his turf. Everyone will [must] assume that Trump is recording every word. (2) A taping system does exist with content that is politically lethal on many different levels. Trump would fight court battles to keep subpoenaed secret tapes in his sole possession, although any such tapes legally belong to the Archivist of the United States under the Presidential Records Act of 1978. Executive privilege does not extend to any White House documents and/or communications that have archival significance.

It seems that Trump mistakenly believes (hopes?) the press will tire of digging for information regarding secret White House tapes if he continues to stonewall by refusing to clarify. This is a grievous mistake.
 
Neither here nor there: If I was President, I would think that it would be a good idea for there to be a record of all official functions so that there never was a 'he said-she said' situation. Comey being a long term DoJ employee should have a fair expectation of being recorded in the White House, especially since DC is a 'one party consent' jurisdiction. I learned about DC law as a result of the controversy. I would have thought that both parties would have to consent to recordings conversation and meetings, but different jurisdictions, different laws.
 
Trump probably can legally record White House conversations, but Trump doesn't legally own any such recordings.

Unless Trump is willing to produce any alleged recording of Mr. Comey, his tweet threat is empty, pointless, and injurious.

With Trumps attempt at crass coercion and his obsessive loyalty issues, no one (with any common sense) will speak openly and frankly at the White House. Not even Republicans would chance a notorious Trump flip-flop.
