Federal agents ignored President Trump's pledge to protect from deportation undocumented immigrants brought to the United States as children by sending a young man back to his native Mexico, the first such documented case, a USA TODAY examination of the new administration's immigration policies shows.After spending an evening with his girlfriend in Calexico, Calif., on Feb. 17, Juan Manuel Montes, 23, who has lived in the U.S. since age 9, grabbed a bite and was waiting for a ride when a U.S. Customs and Border Protection officer approached and started asking questions.
Montes was twice granted deportation protections under the Deferred Action for Childhood Arrivals (DACA) program created by President Barack Obama and left intact by President Trump.



Montes had left his wallet in a friend's car, so he couldn't produce his ID or proof of his DACA status and was told by agents he couldn't retrieve them. Within three hours, he was back in Mexico, becoming the first undocumented immigrant with active DACA status deported by the Trump administration's stepped-up deportation policy.

Rather than Trump, inattention to detail seems to be his undoing. Having 24/7 bodily possession of his ID and DACA papers should have been a highest-priority.

Spokeswoman Jenny Burke said the department had no record of him renewing his DACA status after it expired in 2015, even though Montes' attorneys provided a copy of his work authorization card that showed his DACA status was valid through 2018.

We shall see then.

Currently, all dreamers are still protected under DACA so this could be a yuge mistake on immigration officials if Montes did renew his status.

I would assume he could come across the border again with his papers in his hands.

In the case of Latinos, a lot have the same name so it is difficult to just look it up in a system so it is very important for somebody to keep their ID on them at all times.

The individual was arrested because he jumped the fence in Calexico entering the U.S. illegally.

This clearly shows he broke the dreamer contract.

I think you are missing some points.

The case asserts the guy was arrested and deported on Feb. 17* without being able to retreive his identification. He then on the 19* attempted to get back into the US and was caught and deported again. The DHS is disputing that they have a record of him being deported the first time. They are claiming his DACA authorization is invalid because he left the country without permission, but he is saying the DHS are the ones who threw him out of the country in the first place.

Also, the kid is mentally handicapped. I think that's important to note.

You realize that indicates he is lying right? That then casts doubts on anything else he says regarding the issue.

So when he was arrested on Feb. 19 trying to cross into the United States, it meant he had left the country without seeking advance permission to re-enter, as DACA rules require.

Gillian Christensen, a homeland security spokeswoman, said in an email that Mr. Montes had not informed the agents who arrested him of his DACA status, but that even if he had, “he had violated the conditions of his status by breaking continuous residency in the United States by leaving and then re-entering the U.S. illegally.”

So not only was he lying, his leaving invalidated his DACA contract.

If you prefer, the claim in USA TODAY is that it is a "learning disability". One that apparently only had a marginal effect as he was still able to keep up in school.

He suffered a traumatic brain injury as a child that left him with learning disabilities that meant a constant struggle to keep up in school and everyday conversations, according to Hincapié. Despite those challenges, he made it through special education courses and graduated high school in 2013. He started taking welding classes at a Southern California community college and paid for it by picking crops in California and Arizona.

What is apparent though is that he can function on his own, commit crime, violate probation and even freely leave the US and illegally reentering.
While those things certainly are bad judgement on his part, I doubt it qualifies as any significant impairment or a mental handicap.
So this claim of "cognitive impairment" or "learning disability" is really of no concern and is likely nothing more than a lawyerly tactic of exaggeration.
And heck, with his US education he is probably more advanced than his peers in his home country of Mexico.

He is a Mexican citizen and should be returned to his homeland.
 
I thought DACA was confirmed unconstitutional. Obama did not have the power to grant special immigration status to this kid.
