Democrats secure votes to block Gorsuch as Senate panel considers nominee

Well, the long wait is over. If the filibuster for Supreme Court appointments dies, it will likely happen this week.

Senate Democrats secured enough votes Monday to filibuster the nomination of Judge Neil Gorsuch to the U.S. Supreme Court, increasing the likelihood that Republicans will enact a rules change to ensure his confirmation and pushing the battle into its climactic final act.

Four more Senate Democrats confirmed they will support a filibuster of Gorsuch’s nomination, giving the minority party the requisite 41 votes to maintain their procedural roadblock under pressure from Republicans.

I wish we could elect adults, instead of children pretending to be adults. Let's see if I can sum this up:

McConnell should not trigger the so-called nuclear option.
Democrats shouldn't filibuster Gorsuch for no good reason.
Republicans shouldn't have refused to hold a hearing for Garland for no good reason.
Democrats shouldn't have triggered the so-called nuclear option years back for other appointees (2013?).
Republicans shouldn't have engaged in record filibustering tactics.


All in all, if we insisted on more adults, rather than children, our country could run more smoothly. But that doesn't seem to be the direction we're headed anytime soon.

We are a nation of partisan children and Partisan children elect partisan children as elected officials, so it goes.

And I think democrats have a good reason for filibustering Gorsuch: he evaded the question of whether he considered Roe v wade settled law. His position on the issue of dark money is also problematic.

I love how excited the Republicans are to use the nuclear option. I'm trying to figure out if

a)They're unaware that they're removing the filibuster for themselves the next time they're in the minority, or

b)They're aware, but genuinely believe they'll be in power forever.

Yes, because if there's one thing I've learned it's that once a party has gained a majority of the Senate, it never ever loses power again.
 
It is a shame that Republicans will feel the need to go nuclear. Senate worked better when they tried to get 60 votes but at this point their is little reason for Republicans to just let Democrats win this one.
Perhaps the best possibility now is to reinstate the old filibuster rules about actually talking for a long time. It should be hard to filibuster.
 
And if McConnell does so he will show that the GOP only care about absolute power.

McConnell already did that on judicial appointments starting back in 1999 with Lott as Majority Leader.

As for legislation, GOPs don't want to deal with the parliamentarian anymore .

That bolded part there isn't really true, or at the very least very misleading. Reid called a record number of cloture votes. The rate the cloture votes that failed was at or below the usual average.

Both Bush and Obama had the same number of federal appointments confirmed during their tenure (325), and the rate they were appointed was almost identical. At the same point in the Bush administration he has 11 more judge confirmations than Obama (218 to 207 respectively), hardly evidence of an out-of-control, filibuster-happy minority.

In the Congressional session before the Nuclear option was used by Reid there were a total of three judge selections that failed due to a filibuster. I don't know if that is a record or not, but definitely a narrow record if it is.

McConnell already has the tyrant's throne after what he did to Garland last year.

It's up to DEMs to make that case in every election going forward as the GOPs have done since 2010.

DEMs must fight the GOP hypocricy of ignoring what they did to Garland to blame DEMs for partisanship .

I think at this point the Republicans should, if they actually embody any conservative ideas at all, offer the Democrats a vote on a constitutional amendment to enshrine the filibuster in a constitutional amendment.

They won't for the same reason the Democrats won't the next time they control the Senate, politicians rarely relinquish power once they have it.

I find it funny that the Democrats talk about whether or not they should filibuster Gorsuch now or hold it for the next Trump appointment.... it really doesn't matter. The filibuster will be killed the next time the minority party tries to use it. Reid established the precedent. Once he did that the filibuster was going to die.

And nuking the filibuster will make the senate less representative because it deprives the rights of the political minority.

The next nominees are going to be to the right of Gorsuch.

All the more reason that I will respect any party that tries to create a constitutional amendment to protect the filibuster.

When you think about it, it is practically a guarantee that any majority party that offers to protect the filibuster will get the amendment passed since you are guaranteed at least all of the minority party will vote for it. All you need is 2/3rds vote in both houses of Congress to pass the amendment.

That was actually the one thing I thought that the Democrats would do first when they had a commanding lead in the House and 60 votes in the Senate. They should have skipped the whole health care battle and tried to first push a guarantee of health care in a constitutional amendment. The laws that you spin off such a maneuver are of secondary concern. Granted, the extra 6 votes would be hard to come by in the Senate, but I am sure they could have pulled at least 4 liberal Republicans.
