Yes, Kobie, it's actually illegal for US Government to use that information against an American. FISA rules require any American caught up talking to a foreign nation to be written out of all reports of conversations by replacing them with terms like Person A or so on. Any action against an American for warrants has to come from regular courts.

It's why what happen to Michael Flynn is a crime. Or even any talking about Trump and associates involved with Russia because it violated terms of FISA.

Using a FISA warrant to gather information on an American citizen is illegal. Why are you trying to argue that it isn't?
 
We know General Flynn was illegally surveilled.
We also know Flynn was a foreign agent.....and heads up, the same is going to be said of Paul Manafort.
 
That's not what apdst was claiming. He was somehow implying it makes the surveillance itself retroactively illegal. I'm aware of the proper redaction protocol from FISA reports; problem is, we simply don't know how the information got from point A to point B.

I am not defending him.. but explaining it correctly. We know it came from NSA and got to FBI and Congress which means it went on high up.

He was illegally spied on. Beware of the people you read who has motives to defend this position of it was illegal. David Kris does a bait and switch on most of his arguments.
 
David Kris has long argued for EXPANSION of FISA against Americans. He has a wide interpretation of the law. In he was one that argued what NSA did with AT&T and other phone companies was legal. Notice if you read at the bottom of the article.. the rules are clearly laid out but he expands them to fit his view. Flynn was not an incumbent nor even picked for a position at the time of the conversations.
If you think you have a case, I suggest you go represent Flynn. I'm sure after his being an agent for Turkey quiets down, you will find a sympathetic Judge....somewhere.

Whether he was surveilled or not legally is immaterial to that fact that his name was unmasked illegally.

Actually a felony. My first guess would be Ben Rhodes. May he rest in federal prison if found guilty. May he be free to felonize again if not.
