The 16-year-old had just crossed the U.S.-Mexico border to San Diego and was going through the San Ysidro Port of Entry. He was carrying two bottles of liquid that he claimed was apple juice. U.S. Customs and Border Protection officers told him to drink it to prove he wasn’t lying, court records say.

He was dead about two hours later.

Perallon and Baird are still employed by the Customs and Border Protection in San Diego, the agency said in a statement.

In a motion to dismiss filed on behalf of Baird in 2015, her attorneys said Acevedo wasn’t a U.S. citizen and had no connections with the United States that entitled him to any constitutional rights.

“Nonresident aliens are entitled to constitutional protections only if they have substantial voluntary connections with the United States,” the attorneys argued.
These Officer are still employed.
None were disciplined.
Should they be fired?
Are their laws where charges could have been laid?
Thoughts are?

Apple juice is normally safe to drink. Only the teen knew it wasn't apple juice and he could have just admitted to what it actually was and accept the consequences.

I'm not sure I understand the meaning of voluntary connections, so I can't reply to that. If the liquid was apple juice and drank it as he did, what would the officers have done? That question is more relevant. Sometimes when your bluff is called, you fold, you don't choose suicide.

Death Sentence, by the border patrol agents? No, The 16 year old could have just declined, or dumped it, or told the agents why he had it. The family confirmed the boy did something wrong....

Did the Agents, Waterboard the 16 year old to drink it? Is there proof or video, that they forced the kid to drink it, or did they just tell him prove it, drink it.........


Wrongful death, Sure...... $1Mill, sure no money will pay for a life.... but the 16year old committed a crime to start this whole thing, Now what if the kid did not bring in 2 bottles of Liquid meth? He probably would not be dead.....


Kinda like the Kid that robbed the Pizza Parlor and was shot dead, by a legal carrying citizen, Sure wrongful death and a life cut short is not excusable, but the kid was robbing a store in the first place.... If not doing something illegal in the first place, likely a life would not be ended short.



So intent fully carrying drugs in?

He was probably a drug mule. Oftentimes, a cartel will hold the family of a mule accountable for their success or failure. Most BP officers have narcotic field tests either with them or easily obtainable.

If the BP officers strongly suspected liquid meth/cocaine in the bottles, then they also knew drinking the contents would invariably be fatal.

Regulations demand that any detained mule carrying drugs within the body (positive x-ray) are to be transported immediately to the nearest hospital because ruptured packets/balloons are lethal.

If I was at the Airport Carrying a half bottle of water, the TSA agent would say DRINK it or toss it.... The TSA Agent wouldn't corner me force me to drink it.
Again unless there was VIDEO/Proof that the Agents forced the 16 year old to drink it, from the sound of it,

Border Agents just asked the kid- "What is that?",
Kid "Apple juice"
BA - "prove it, drink it"
Kid - "!@#$, Gulp".....

If this went down as explained then the agents need better training. They kid decided it was better to drink meth and continue the lie verse come clean and accept the consequences.
I don't see any way the agents forced him to drink his drugs.



Now if the agents knew it was in fact drugs abd somehow physically forced him to consume the meth then we got a totally different case that should see criminal charges.


The ultimate responsibility lies with the kid in this case, he choose how this would end.

His family should not have received a damn thing.

If my sister had balls she'd be my brother.
The guys screwed up. Plain and simple. Anyone with a lick of professionalism about them would have confiscated and tested the bottles.

I don't see a screw up. He lied in an attempt to commit a felony. The officers didn't owe him anything.

They had equipment available that would have had an answer within a few minutes.
Lastly, live testing of suspected drugs is now a policy that you agree with??

Assumption, as the boy said it was apple juice.... Not suspected drugs,

My thoughts are, the border agents took the kid at his word, and trusted what I would assume were his claims it was just apple juice.

The problem was, the Agents trusted the kid. Turns out, they shouldn't have.

Unfortunately, the bleeding hearts love to flip this on it's head to make it appear they were animals. The kid could have chosen life. Darwin theory confirmed.

At some point, someone on the left with some wisdom will realize this kind of bogus news nonsense is imploding the agenda, and will do what they can to stop it.

I go to the airport and the customs guys say drink your liquid or dump it in the provided garbage container..

If I had drug water (which I never do or will TSA)... I would toss it or admit it was drug water... not drink it.

Is there any chance that the kid honestly believed it to be apple juice? If so, then the agents were either alos under the idea that it was AJ, or they were indeed negligent or worse. If not, then he played his cards poorly and the agents picked a winning hand.

Actually when you add it all up..... there is nothing justifiable..

1) Kid is 16, not 5, Unless the kid had a mental defiance to choose right from wrong.... it was not expressed.
2) Its not his apple juice, he didnt pour it likely, It was given to him, If the 16 year old kid was ignorant for someone to had him 2 bottles and tell him its apple juice, that likely was NOT from someone he knows or trust, is just irresponsible.... "Dont take Candy from a stranger"
3) If the parents gave it to him and said it was apple juice then the parents are wrong, but from the report the parents didnt know
4) He did not buy the juice, its was not his juice, why would he drink it?......


Again a life was lost, wrongful death... BUT this is 100% avoidable....100% so many failures in action from the very beginning....
