New effort to break up the 9th Circuit Court

As judges on the 9th Circuit Court of Appeals weigh the legality of President Trump’s immigration executive order, a Republican push to split up the controversial court -- and shrink its clout -- is gaining steam on Capitol Hill.

Republican Sens. Jeff Flake and John McCain of Arizona introduced legislation last month to carve six states out of the San Francisco-based court circuit and create a brand new 12th Circuit.

They argue that the 9th is too big, too liberal and too slow resolving cases. If they succeed, only California, Oregon, Hawaii and two island districts would remain in the 9th's judicial fiefdom.

Right now, Flake said, the circuit is far too sprawling.

“It represents 20 percent of the population -- and 40 percent of the land mass is in that jurisdiction. It’s just too big,” Flake told Fox News on Wednesday. “We have a bedrock principle of swift justice and if you live in Arizona or anywhere in the 9th Circuit, you just don’t have it.”

Flake says it typically takes the court 15 months to hand down a decision.

The number of cases waiting for a ruling exceeds 13,000, according to recent reports. That is more than double the backlog of the Circuit Court with the second largest backlog.

Seems reasonable due to population shifts. There are 12 circuits now and 13 is lucky.

Move Arizona to the 10th circuit, keep California and Hawaii and the territories in the 9th, then Washington, Oregon, Alaska and Nevada to the new 12th.

When the Obama administration floated the idea of expanding the number of judges due to backlog, the republican complaint was "judicial packing"(and not without some justification). That is exactly what this would be, and why it will not happen. What would make sense since the 9th is so large is to split some of it's area to other courts. Then no packing.

And the 9th's rulings are not overturned over 99 % of the time. Even among cases that make it to SCOTUS, 6th circuit is overturned at a higher rate, and the 9th rate of being overturned is pretty close to the average.

Politics aside, these cases sitting on their clerk's desks, involve real people with real issues and they reserved to have the judges either put up or shut up, BUT RULE ALREADY!

Rush Limbaugh said that the other day. I'm sure he never bothered to fact check. Or maybe he confirmed it on the alternative facts website.

Then again, should that matter?
And is there anything about the 9th that might attract appellants? Like the Washington State case about the travel restrictions, for instance.
In any event, it sounds like maybe the 9th should be broken up.

I think it's a good idea. The 9th has a huge workload. They serve more than any other District.

The timing could be better but this has been in play for years. If you looked at the statistics in the article, the West has grown and so has the courts workload.
