I don't need to. It says American citizens, "shall not be deprived of life, liberty, or property without due process".

Due Process is fair treatment in a normal judicial system. Government regulations, that aren't created legislatively, aren't laws, nor can they legally be used to deprive someone of his life, liberty, or property.
