Reversing its previous ruling, the state's highest civil court set arguments for March in a lawsuit seeking to halt same-sex spousal benefits that America's fourth-largest city offers its municipal employees. The nine Republican justices had ruled in September not to hear the case in the wake of the U.S. Supreme Court's ruling from the previous summer that gay marriage was constitutional nationwide. But Gov. Greg Abbott, Lt. Gov. Dan Patrick and state Attorney General Ken Paxton filed a subsequent brief saying that the case could serve as a platform to help Texas restrict the scope of the high court decision."Major constitutional rulings by the United States Supreme Court routinely give rise to waves of litigation exploring the contours and limits of the court's pronouncement," the three Republicans wrote in an October brief. "This case is one of many cases that will require state courts to examine the scope of the right to same-sex marriage announced by the Supreme Court."

It noted that the Texas Constitution had banned gay marriage after a 2005 amendment approved by the Legislature and voters statewide, further arguing, "Principles of comity, federalism, and the rule of law should make state courts particularly wary of using the federal constitution to expand upon newly created substantive due process rights that have the effect of undoing the work of state lawmakers."[/FONT]

What a waste of time and money. A disgrace why are some people set in their ways to treat people as lessers and not respect their rights. Makes me sad.

Considering how much the country's overall opinion on gay marriage has changed drastically, that is most likely the case.

I don't see this getting through either. I'm just annoyed this is still coming up.

The courts forced it on a lot of people, so they're fighting back. Between this and Obamacare it's pretty obvious liberals don't understand that forcing things through doesn't go well.

Makes me more sad that some people are that filled with hate and against equal rights. But I get what you are saying, correct me if I'm wrong but I think I might remember you saying you are part of the LGBT community? I could see how annoying could have a stronger foothold with you for sure.

Government marriage is not a right. Calling a government service a right is like calling a sword a tooth brush.

Uh. Given that this wasn't allowed to go through the Democratic or Representative process, but was instead imposed by above, how could it not create backlash and opposition?

No regrets. Let them take it to the new SCOTUS and strip my family of our spousal benefits. This is a worthy cause. Attacking American families because they practice committed relationships, raise children, and have the audacity not be the opposite sex. I can't imagine that there was ever any other path that would have persuaded these people in my lifetime that I was not a threat to marriage, and even now as I am married, they seek to find any way to attack my right to be treated equally under the law. No, I am happy that it was done the way it was.

Nothing's being forced on anyone. Unjust laws are being struck from the books. Why can't a 'libertarian' get behind the idea of removing useless laws? Are legislating morality and legislating scripture libertarian principles?

A government service shouldn't be withheld from anyone who could benefit from it. Or just wants to avail themselves of it. Otherwise, abandon the whole idea and remove all advantages to marriage.

Wrong as usual. The 14th amendment was created thru a 2/3 majority and 3/5 of states ratified. All you had back in 2005 was tyranny of majority against an irrationally disliked minority. But the reality is 60% now support it. So you have nothing whatsoever, except bigotry

Even Trump has called it "settled law" So go ahead with all the backlash you want. We will just laugh in your face and throw your traitorous county clerks and anyone else who tries to interfere in jail

They will use whatever logic they can to get rid of something they never agreed with. It's really no different then what the supreme court did to come to their ruling. Dishonestly get meet with dishonestly is a good example of karma.

So what i can glean from this is the same judges rejected the case 8-1 in september, but their party (why the **** judges are elected or have a party is beyond me) pressured them to take the case. Justice by politics is obviously no justice at all

There must be no real cases at hand to be taken care of in Texas for its highest court to waste time on this and humiliate itself and possibly get impeached like alabama's chief justice, when a federal court instantly crushes any decision that undermines Obergefell...after they had refused to even hear the case

Whats even worse is this particular move isn't about trying to stop gay marriage it's about trying to "halt same-sex spousal benefits that America's fourth-largest city offers its municipal employees"??? It doesn't get more more hate filled, vile and ignorant than that. It's the complete opposite or equal rights and its appalling.

Oh and to answer your question, NOBODY is objectively harmed by the equal right to marry.
