Texas court hearing case to limit gay marriage legalization[W:262]

Re: Texas court hearing case to limit gay marriage legalization

What a waste of time and money. A disgrace why are some people set in their ways to treat people as lessers and not respect their rights. Makes me sad.

This is what happens when the system is circumvented. The Supreme Court can't make law, so when they attempt to do so, it's easily challenged.

Re: Texas court hearing case to limit gay marriage legalization

Wrong as usual. The 14th amendment was created thru a 2/3 majority and 3/5 of states ratified. All you had back in 2005 was tyranny of majority against an irrationally disliked minority. But the reality is 60% now support it. So you have nothing whatsoever, except bigotry

Even Trump has called it "settled law" So go ahead with all the backlash you want. We will just laugh in your face and throw your traitorous county clerks and anyone else who tries to interfere in jail

so now what you are saying is that tyranny of the majority is ok because you support it?
hmm kinda wishy washy if you ask me.

Re: Texas court hearing case to limit gay marriage legalization

This is another one of those cases where they will never be able to prove any just grievance from two people of the same sex being legally married because there simply is none. Under what legal justification would this case be validated to deny specifically same-sex couples this benefits? One can cite religious freedom all they want, but one right cannot usurp another right, and in this case no one's religious freedom is infringed by the mere existence of same-sex marriage.

I'm still trying to figure out any possible legal argument for this. Simply believing that the 2015 SCOTUS ruling as illegitimate doesn't make the ruling so.

You do realize marriage isn't dependent on government contract, right? You know that people straight and gay are married by private contract, right? Nothing going on here eliminates the "existence" of gay marriage. It's frankly silly to even suggest such a thing.

Not really. Using the courts to make law is the best way to ensure what you did will remain in place. That is one reason why I despise the practice.

Libertines only convinced a few judges that homosexual marriage was a right

But never proved that a majority of the voters agree

The Judicial Branch doesn't have the power to make law.

The Judicial Branch doesn't have the power to make law.

Doesn't mean they don't make law though. Hell, the Supreme Court changed the ACA just to make it constitutional, and yet, they don't have the power to do that.

The entire reason gays went to the supreme court instead of continuing the fight on the state level is because they wanted to bypass the process and make what they wanted untouchable. People are perfectly aware that the Supreme Court is untouchable by all the other branches and they use it to their advantage more and more often.

Laws made by the Judicial Branch aren't constitutional.

Laws made by the Judicial Branch aren't constitutional.

And yet the Supreme Court is the one that decides that. Do you see the problem that people exposed with the system?

Re: Texas court hearing case to limit gay marriage legalization

Government marriage is not a right.
Marriage IS a right and the government has no authority to tell anyone whom they can marry.

Calling a government service a right is like calling a sword a tooth brush.
You have no idea what you are talking about, again.

Saying marriage is a right is not saying government marriage is a right. Marriage is a broad topic and is in no way dependent on government contract.

You have no idea what you are talking about, again.

I know exactly what I'm talking about actually. Thanks for sharing such a solid argument, btw.

Re: Texas court hearing case to limit gay marriage legalization

Uh. Given that this wasn't allowed to go through the Democratic or Representative process, but was instead imposed by above, how could it not create backlash and opposition?
Because some morons are far too ignorant? Did interracial marriage go through an other process or you oppose that too?

Re: Texas court hearing case to limit gay marriage legalization

BULL CRAP. Did you have to marry your best friend?

Sigh. I already went over that dumb argument, thank you. Either read the thread and come up with a rebuttal or stop posting.

Oh look, the "they did here too so it must be fine" argument. Who would have thought that was coming?

Re: Texas court hearing case to limit gay marriage legalization

They will use whatever logic they can to get rid of something they never agreed with.
By far most of society really does not care what some backwards primitive thinking assholes think and that IS a good thing.

Ah so your saying Gay people are second class citizens when it comes to things like civil unions. Spouse benefits, and legal protections are just for straight people...

Some of us are more equal than others! Is basically your argument. Congratulations, on being born inherently more free than other US citizens...

What mental gymnastics do you use to justify having an opinion on something that's none of your business?

Re: Texas court hearing case to limit gay marriage legalization

Government marriage is a useless law and yet people demand it expanded. I reject their reasoning.

But the laws are not useless. Collectively, they establish rights and obligations, including parental rights, property rights, divorce.......etc. It's a long list, which is why legislators over the years expand and refine the laws, and why couples decide to be legally married instead of just at their church or other place of worship. Creditors, hospitals, schools, and many others rely on 'marriage' laws for legal certainty in many situations.

It's fine to disagree with the law, but you can't intellectually honestly label the laws "useless."

Again, your arguments are very sound and you really should share them. Really, how does that in any way combat my argument?

They did not make new law. Educate yourself about the court.

That's irrelevant. If laws depend on the agreement of the majority you have mob rule, not democracy.
You don't have a free society if some of the people have more rights than others.

People get parental rights with marriage, people can buy property together without marriage, people can establish rights through contract without government created contract, and people can end a contract when they agree to do so. The rest of your list is special treatment matters that are frankly unlawful.

Re: Texas court hearing case to limit gay marriage legalization

:lamo:lamo:lamo Can you cite a single one they made?

You mean other than the law they clearly created here?

There's over a dozen legal benefits of marriage, death benefits, Social Security benefits, IRA benefits, estate benefits, leave benefits, tax benefits. the list goes on. All of these benefits are recognized under the law so why the hell should same-sex couples not be able to enjoy those same benefits as heterosexual couples? The only reason is to perpetuate discrimination by people that hate homosexuals.
