If a customer comes in to your business, buys something, takes it home and breaks it, then brings it back for a refund, are you going to give him his money back?

You're taking the old axiom literally.

The bar of reason must be applied.

But the general thrust here, is: Good business is trying your best to fulfill your client's or customer's needs. They are your boss. They are your bread & butter. Treat them well!

(I would also say that calling one's African-American customers the 'N' Word, is not displaying high-level skills in conflict resolution)

I posted that it is not absolute and I got answers, like yours, that said only if the business wants to stay open.

I have to admit it is hard debating someone with such limited knowledge that they only know four letters of the alphabet - L, M, A, & O and uses nothing but bullying and name calling to deflect from relevant questions because they don't have anything substantive to offer. By that logic there isn't ANYTHING a Dairy Queen franchise owner could do that should get his license revoked. Dairy Queen doesn't want to be associated with blatant racism against its customers, so they cut him loose. It's 1000% his fault and no amount of attempting to blame this on liberals world wide is going to change that. Weren't you supposed to be on the side of "personal responsibility"?

WOW!!! what is wrong with people? This nutball had a complete meltdown over his employees making a mistake so it caused him to lose his businesses. What a completely dummy and moron. No question the guy is a vile human being. Dairy Queen is correct in yanking his franchise license, if that is what they did. Of course, they can't take his business, unless DQ has some ownership rights to it.

Franchisees do not "own" anything. They, more or less, just lease a license which gives them in return a business model, brand name and right to sell someone else's product. There are strict rules in place that must be followed. It's a far cry from owning your independent business.

Not true. In general, a franchisee is licensed to represent the brand following the methods and branding identity required by the franchising organization. If a franchisee violates the agreement, the franchisor can revoke the license to represent their brand. They can't take the business.

Revocation means all identity, menu's, etc., must be removed. They can't take the building, the equipment, etc. That is the sole property of the franchisee. A franchisee could re-open their business selling the same type of items, but there can be no implied connection to the original franchisor operation.

The only exception to this rule is when the franchisor finances the purchase of the business. McDonald's does this as a manner of course. For example, McDonald's frequently owns the land the restaurant is built on and leases it to the franchisee. It's possible that lease includes a stipulation that the business must be a McDonalds Crop operation. I don't know if DQ follows that model.

This happens frequently.

You have it all wrong.

This man was free to enter into a contract to franchise with Dairy Queen.
This man allegedly violated the contract, and Dairy Queen investigated the allegations.
Upon finding this was not an isolated breach, they proceeded to terminate the agreement presumably for breach.
This man can contest this with an attorney, if he so chooses, through normal legal avenues.

Nothing in here relates to a career or involuntary restriction of someones freedom, or losing a business, etc. If he wants to re-open as a non-franchise, he can. If he wants to try and enter into another (presumably non DQ) franchise, he can.

If the employees want to continue to work for him in that capacity, they can. But again, that's up to him, he is the employer.

Do you not want him to be free to enter such contracts? Do tell.

Yeah, the guy can still sell ice cream. But he certainly cannot do it as a Dairy Queen. He cannot use their sighn, he cannot sell their ice cream. he cannot use their trademark on items, like Blizzard, and he probably cannot even use the building as is, the style and layout of which is most likely also under special licensing agreement like a McDonalds.

We give convicted killers a second chance quite often in the US, and hope that they learn their lesson by the time they're paroled. But a man who says a word that we don't like deserves no second chance. Feelings now have a higher worth than human life.

We have no idea what caused him to snap, since there's no video of the incident. Deianeira Ford has since hired an attorney, and may be seeking money from Crichton. Experience has taught me to be skeptical in these situations.

Possibly true. Since I currently have no full knowledge of the agreement I couldn't say one way or another. Jim my own the property and facility or he may not. Haven't read anything about that yet.
