It's a tough question. We have on one side cases like this where pretty much anyone not a dedicated pacifist would at least shed no tears hearing of their deaths, versus those sentenced to death but are innocent. I'm not suggesting that the choice is clear cut for everyone, but it is for me - the relatively high error rate makes it impossible for me to support the DP as it's implemented in the U.S.

I know one argument is those released somehow prove that the system WORKS, but I can't be comfortable with that. The system worked for many of them because people opposed to the death penalty use significant private funds to find innocent people on death row and exonerate them, but those efforts are essentially needed to overcome the system in place.

There were stories in the paper this week marking the 10 year anniversary, and I didn't read them because I just don't want to have to relive it. I also feel very sorry for the family, especially the father of Channon. You can see in his eyes that even now the murder/torture torments him. I'm not sure it's possible to 'forgive' them in a case like this, but the lesson that anger and hanging onto the hate just hurts the person, and does nothing to the targets (the murderers) who just don't care, is true here. Wish he was able to find some sort of peace somehow, but understand why he cannot.

I know that if he brought a gun to court and shot a couple of those perps, I'd not make a good member of the jury because I can't see convicting him.

The problem is there is no good way to guarantee that. If the prosecutor decides to seek the death penalty, and wins the case, all it takes is a jury willing to impose, and they've often done it for people who were actually innocent.

And I guess in a broader sense, I can easily justify the death penalty in some kind of ideal system, such as what you suggest. But the problem is I have to take the known problems in how the death penalty actually works - and condemning innocent people is just the biggest flaw - and base my support on what is instead of what how I'd like to see it operate.
