Twenty-one states challenged the overtime expansion, arguing that Congress never intended to set any salary threshold for the exemptions or to allow the threshold to be raised every three years, as the Labor Department’s rule specifies.

“This is a victory for small business owners and should give them some breathing room until the case can be properly adjudicated,” said Juanita Duggan, CEO of the National Federation of Independent Business, which is separately challenging the requirement.

So we have known about the law for 6 months, but the courts wait till the last week before it was to start to object?

This sort of poor performance is what kills confidence in the Elite.

This should not have happened.

I agree, it shouldn't have taken this long.


Maybe if the GOP hadn't held up judicial nominations (not just SCOTUS), there would be more Judges to handle cases.

Of course, but it would have to go to the appeals court first, then be appealed to the SCOTUS.

I'm not sure how this is a win for small business, small business don't have "managers" making 23k. It's certainly a win for fast food franchises that pay thier managers horribly
