WASHINGTON -- The Supreme Court agreed Friday to take up the controversial issue of transgender rights, instantly transforming what had loomed as a holding-pattern term with only eight justices into one featuring another major social policy issue.

The justices will consider a Virginia school district's challenge to Obama administration guidelines requiring that schools allow transgender students to use restrooms matching their chosen gender, rather than birth gender.

I'm surprised that SCOTUS took this case. I already predict that the court will split 4-4, thus leaving the 4th Circuit ruling in favor of the transgendered in place. However, this will not be settled law until the court is once again at full capacity. At this time, it will just be taxpayer money wasted attempting to overturn the Fourth Circuit's decision.

That's a dumb move. SCOTUS has to decide exactly what is transgender and what isn't, or more accurately, does wearing a tu-tu grant a man passage into the women's restroom? Or do you need a note from your doctor.

Yep, but, everybody's got their panties in a wad over this. It needs to be settled one way or another and this will have to be reheard if it goes 4 and 4. However, if Clinton wins that means that it can't be reheard for at least the next for years. The Republicans vow to not allow her to appoint a new Justice. Now that'll be an entertaining HBO ongoing documentary on "The Greatest Show on Earth".

ask yourself some simple questions...


can you freely:


exercise the right to bear a firearm there?

exercise the right to say anything you wish there?

exercise the right to protest there ?

hold a prayer service there?

can you exercise the right to privacy there?

the schools are public property, being that the government can make laws to prohibit the exercise of such rights.

private property belonging to have individual or group of people is their dominion, to allow or prohibit what they chose in the exercise of those rights.

I'm very happy that they took the case. I disagree that it will be 4-4 though. I think it will be 6-2, or 5-3, upholding the principle of Equal Protection (as they did in Obergefell v. Hodges) and possibly also on Privacy (as they did in Roe v. Wade). The reason I feel this way, is because there are already numerous laws on the books that will take care of any breaches or torts caused by nut-blades in the wrong bathroom that are doing bad things they shouldn't do.

As for HB2 in NC, I disagreed (still do) with the way the Charlotte City Council wrote their local regulation that started the whole thing, but I also disagreed (still do) with the extreme overreaction of the NC Legislature in writing and passing HB2. The Charlotte regulation would have made it almost impossible to enforce laws already on the books against voyeur activities and other sexually based crimes in public or private restrooms and baths. Then HB2 was written which was (still is) a hateful law that would allow for legal discrimination and other actions that would move us backwards regarding equal protection under the law.

Knowing how screwed up this court it they will allow men to enter women's bathrooms and locker rooms.
They will deem that privacy rights of women do not matter and that tyranny of the minority will continue to thrive.

You are talking around the Q. Let's put it this way. Public schools are paid for by the taxpayers. Transgendered people who own homes also pay property tax. And, of course, the federal funds that go into schools are paid by income taxes. They pay those too. If they are to be treated equally, then they should be able to use the bathroom which fits the gender they live as.

Of course, there is a way out of this. New law - Trans people don't have to pay any property tax or income tax. Then they don't have a dog in the fight. Of course, that would discriminate against everybody else who do pay taxes.

None of this, of course, applies to private schools, which are not funded by taxpayer money. Don't like the bathroom law? Send your kid to private school.

I don't get how this logic even works. Kids don't transition nor do they usually take hormones. They are just people that have been classified as transgender by doctors and people want them in the bathroom of the other sex? How are they even beginning to live as the other gender when they have done nothing but change their clothes? How does that logic even make sense? Using this bathroom or that bathroom or this locker room or that locker room isn't a human rights issue, being able to use a bathroom or locker room against the will of everyone else is again not a human right. The transgender case doesn't even make sense. Schools are also NOT like other public bathroom/locker rooms where the other people don't know who they are, but places where the other students knew them for years as the other gender and will see them as the other gender no matter what some idiotic liberal might think or dream is the case.

This is not a situation where people are shopping for material goods or services. This is public education, and thus falls directly under the government, unless it is a private school. You cannot discriminate. Or would you rather go back to the 1950's and keep black kids out of good public schools? Oh that's right. Black people don't have the right to material goods or services, just like trans people. Except that, once again, education does not fall into the category of capitalistic goods and services. LOL.

I do have Libertarian leanings, but anarcho-capitalism is not one of them.

the USSC court has ruled no one has a right to education, if you had a right to material goods or services, you would have a lien on a another person or an entity, and no right exist that does that

states create the privilege of education, its not a right

The right to an education means that children can not be denied an education. This doesn't just mean that children must be educated, but that children must be educated in the way the government feels is fit. Do you see the problem with their logic yet?
 
The purpose of education is to create taxpayers. The side benefit is a better society making and buying better things.

Exactly. Which would also mean that your right to the material good or service trumps the rights of the other party and their consent to provide the material good or service. The entire notion quickly becomes one of servitude and slavery.
