No one said it did make your laptop government property. It is not the FBI or DOJ who determine if the Act has been satisfied. There is a separate process and bureaucracy for that.

You're alleging the possibility that something could have been under subpoena to conclude that the property could not be destroyed. The stupidity of this argument, taken to its inexorable conclusion, would forbid the destruction of any property.

How long while a person is a government employee are they allowed to store confidential documents on their personal property?

Until they allow the device to be examined to ensure they complied with oversight. If there is an active investigation, until the investigation is concluded.

One of the things that keeps a soldier (or a diplomat in a difficult post) going is the knowledge that your government will do its damnnest to save your ass, be it artillery, air strikes, supplies, or manpower, and everything else within reach will be available to save you.

The men at Benghazi were forgotten and left to die, because no one gave a ****. And then they lied about it.

There was no investigation into the contents of the laptops except for that of the FBI who made the deal to acquire access.

I said nothing about a subpoena. In fact I specifically said otherwise. Records related to their job, regardless of where they reside, must be kept until the proper process is followed to allow their destruction. The FBI and DOJ are not part of that proper process.

That's not actually how it works. When government employees leave their job, you don't keep their laptops until someone determines whether there are records requiring retention in them; you just wipe the laptop and move on. It's the responsibility of the employee and his/her department to ensure that all relevant records that aren't being transmitted by e-mail (which is automatically backed up) are being backed up to a network share. There shouldn't be any documents on a laptop that are subject to retention and are not also stored on a network share.

If they don't have someone's records, they should take care of that at the exit interview.

The idea that they should arbitrarily have perpetual ownership of their property is absolutely ****ing ridiculous.

I never claimed they did. What they do have is ownership of the documentation. It is also illegal to put classified material other than its proper place, which is not a private laptop.

Standard procedure for the FBI would have been to just return the laptops. No one has yet demonstrated why returning the laptops would have been better than destroying them.

No they didn't. If i download a document, the government doesn't retain ownership of that piece of my computer, that's ridiculous.

The person who owned the laptops requested them to be destroyed by the FBI as a side deal to immunity. I dont think you quite understand what happened.
