Wait, isn't marriage laws the same for everyone now? If so why the need for specialist in "gay divorce". Will gay divorce lawyers refuse to take divorce cases between a man and women? Oh wait, that was a baker refusing to make a cake for a same sex couple.:mrgreen:
I don't see how a gay divorce would be any different from a heterosexual one.
I think there will be problems that will differ from hetero divorces.
A lot of those will involve the children.

I agree - if I were 18 or 19 and thought about being a lawyer - I'd certainly see the broadening of divorce to now encompass gays and lesbians as a huge career opportunity.

Only one or possibly none may have an actual biological claim to the child first. Second, if the child is adopted to a lesbian couple, both parents can have a claim to be the "mother" of the child. That's just off the top of my head... I haven't really given it very much thought.

I would imagine that it would go as it would in any divorce: the judge would decide which parent is better suited for the child, or there would be split custody.

I would guess so, however there may be additional mitigating circumstances with say a lesbian couple with two children, where only one of the women has a biological claim, and the other has a higher paying job. Since both can claim they are the children's mother... I'm sure the lawyers will quickly figure out if there is a change in tactics.
I've answered in the up thread but, some states haven't allowed name changes to signatures, DLs, wills, taxes, property etc. All this will come into play during a divorce.
So, more government discrimination.
Not to unnecessarily parse words, but it is required here.
Is there precedent for any of this? Same sex marriage just came to the remaining thirteen holdouts, otherwise there has been ssm since 2004.
