They can be sued, and courts hand out the punishment. You shouldn't be sued for failing to serve someone. Fired? yes Sued? **** no.

The authority of the states and the authority of the people of each state to set policy within their state on those matters in which the U.S. Constitution are silent, per the 10th Amendment, has absolutely been violated.

remind us what supports that lie again? oh thats right nothing . . state rights can not violate individual rights. The 10th is 100% intact and will have to follow the ruling of scotus.

Why should the government have ever been put in charge of deciding whether you get to enter a contract with someone else or not?

Because someone has to enforce the contract when a party breaks from their agreement or their is a dispute over whether the contract is enforceable. The courts are part of the government, by the way. And the police (also part of the government), help to enforce the court's decision. Oh, and the legislature has to be involved to ensure that certain types of contracts (one for child labor, for example) are void on their face.

This is what I find interesting. the SCOTUS struck down the defense of marriage act because they said that the federal government did not have the power to define marriage.
so what the SCOTUS did was break their own previous ruling by ruling by defining marriage at the federal level.

I think it needs to be reargued under that argument.
SCOTUS decided a court case where the decision itself would create law. They did not break their previous ruling.

Why do people get benefits for being married anyway? That makes zero sense.
I agree government should stay out of the marriage business. It is a personal relationship between two people and they should make a contract setting the rules.

They can set the terms of the contract and never have to worry about terms that might be added in the future they don't agree with or aren't allowed to be opted out of in pre-nup. Sure, it's more expensive, but I think the upside of taking that path far outweighs that.

It has worked for me in a poly relationship with 5 women. It cost nut has done all we needed. Taxation of course does not recognize our legal household but one can't have everything. lol

If I was feeling charitable at best, that would be what you are doing.

I am aware that you are blinded by your personal prejudices, but the SCOTUS decision is Constitutionally sound.

What "personal prejudices" could you be referring to?

It is assuredly not sound, which is the entire reason for my frustration with this absurd ruling.

The First Amendment protects you from being targeted for your religious views or religion in general, and protects you from being punished or persecuted for having those specific views. It does not protect you from punishment when your religious views come into conflict with a neutral rule or law. You should not be allowed to not do your job just because your religion disapproves of certain people. That is not what the First Amendment, right to religious freedom was meant for or says.

The first does not allow you to break the law in the name of religion. I can't imagine people thinking it would offer such a deal.

that judge can do what he wants. the constitution says that the government cannot force them or discriminate against their religious views.
the state has to make reasonable accommodations. the SCOTUS has ruled on this time and time again.

Nope. Read the link. He was told he was going to be sued (which they did file a case, and dropped it after he resigned) and he was going to lose, so he better resign.

There is no way to believe that the First Amendment protects any of these people from not doing their job just because they feel they have a religious objection to it. Find another job or deal with it. There is no excuse for using religion to not do your job, in accordance with the law. And their job is to issue marriage licenses or perform legal marriages for the state.

No man really, my religion requires that I not do any work, so I can stop doing my job tomorrow and my boss still has to pay me because MY FIRST AMENDMENT RIGHTS.

Actually, it would likely include both given the AG and governor (I think) encouraging them to do this but informing them that they would likely be sued for doing so.

The next issue will be polygamy. The whole place would go up for grabs. Baking cakes with room for 3, 4, 5, 6, figures on top oh may. There would be a frenzy to rent wedding halls for six sets of families and friends.
