AP sues State Department, seeking access to Clinton records

WASHINGTON (AP) — The Associated Press filed a lawsuit Wednesday against the State Department to force the release of email correspondence and government documents from Hillary Rodham Clinton's tenure as secretary of state.

The legal action comes after repeated requests filed under the U.S. Freedom of Information Act have gone unfulfilled. They include one request AP made five years ago and others pending since the summer of 2013.

"After careful deliberation and exhausting our other options, The Associated Press is taking the necessary legal steps to gain access to these important documents, which will shed light on actions by the State Department and former Secretary Clinton, a presumptive 2016 presidential candidate, during some of the most significant issues of our time," said Karen Kaiser, AP's general counsel.

"The press is a proxy for the people, and AP will continue its pursuit of vital information that's in the public interest through this action and future open records requests," she said.

It would appear that Mrs. Clinton's "press conference" yesterday did little to quell the outrage over her obvious attempts to circumvent the law and keep these documents hidden from the public. I wonder if she even realizes that the more she fights this the worse it is going to get...
 
The Emails have already been sanitized.

I'm sure the State Department will have no problem handing over her Emails.

They'll probably make sure its done in a very public way so they can show everyone just how transparent the Obama administration and Hillary Clinton are.

You're telling me that the NSA can peep through all of our **** and yet when we ask Hillary to show her emails because she's being a secretive douchebag suddenly it's all about her right to privacy and ****? GIVE ME A ****ING BREAK AAAHHHHH!!!

It would appear that Mrs. Clinton's "press conference" yesterday did little to quell the outrage over her obvious attempts to circumvent the law and keep these documents hidden from the public. I wonder if she even realizes that the more she fights this the worse it is going to get...

I don't know about US law, but here in Canada our FOI legislation makes it an offense to destroy any document, in any form, that is the subject of an official FOI access request. As such, if Hillary Clinton or the State Department were to destroy or alter any emails subject to these requests, they should be prosecuted under the legislation. Now that Clinton has admitted to possession of the personal server, that server in effect becomes under the care and control of the State Department for purposes of the FOI process. An agent or employee of government cannot avoid the provisions of FOI by holding official government documents personally.

I can envision this thing playing out to be a battle over possession of that server with the state insisting on taking possession of it and the Clintons fighting them tooth and nail... only for it to be revealed a year down the road that it "accidentally" fell into the bathtub while it was plugged in or something.:roll:

This is good. Now I hope they win, and ALL diplomats will be required to use a .gov address going forward. Primarily for the national security of it. Unfortunately, her supporters are unfazed by this revelation, demonstrating the blindness of the partisan. And such happens on both sides.

Now that the Emails are sanitized thoroughly ( AP is well aware of this ) the AP can start their lawsuit.

The State Department will comply and hand over all the Emails that Clinton gave them and when nothing incriminating is found, the Clintons, the Obama administration and the AP and other left wing media outlets can claim that this was red herring all along.

The State Department will also use this opportunity to publicly brag about how " transparent " they are.

Presuming congress does not have to force the state department into actually demanding that server. I suspect there is a ton of **** on there the Obama administration simply does not want to know itself..........

Damn, I bet old Hillary longs for the days of paper shredders and being able to "lose" documents that show up the day after the deadline. Shows how out of date she is
 
I wish the AP well in this endeavor, but suspect it will result in little. Unfortunate...

Yep, the Obama DOJ will surely get right on "investigating" the Obama State Department - just like they did with the IRS. Not a smidgeon of corruption, much less any crime, will be found although some bone-headed mistakes will be acknowledged- so why any waste money pretending to do so?

They sure are having a hard time finding a replacement for Holder. Maybe they're having trouble finding another person willing to check their integrity at the door for the last couple of years of Obama's reign.

Because State didn't comply with FOIA requests. AP is due damages, and the employee(s) responsible for non-compliance can be fined/sanctioned/etc.

This isn't going to go away until that private server undergoes computer forensics to extract every last deleted email that's recoverable, and has been reviewed by the appropriate authorities.

The AP isn't partisan. The Obama administration is the least transparent in history, and ALL diplomats must use .gov e-mail addresses going forward, NO exceptions.
 
I was very surprised by this news. Usually when a liberal defends questionable actions by saying "trust me" over and over the media accept that and move on to whichever fat Republican they have in their gun sights. The idea that they are actually looking into this instead of forcing the GOP to do it all themselves comes as quite a shock.
