PHOENIX, March 5 (Reuters) - A jury in Arizona failed to reach a verdict on Thursday in the sentencing retrial of Jodi Arias, sparing the former waitress from the death penalty for murdering her ex-boyfriend in 2008.

Arias, 34, was found guilty of the murder in 2013 but jurors at that trial deadlocked on whether to give her the death penalty. A new jury of eight women and four men was seated in October to hear a sentencing retrial but announced on Thursday it could not decide on a punishment.

Maricopa County Superior Court Judge Sherry Stephens said the jury was hung and declared a mistrial. The judge now will sentence Arias to life in prison or to life in prison with the possibility of parole after 25 years.

Both sides will have an opportunity to make their case to the judge before she makes that decision.

No, she's not a Nancy Grace case, although Nancy has followed her. This has been a big story for a few years.

Why did I post it? Because it was Breaking News on MSN.

Do I agree with the trial verdict of "Guilty"? Yes. Do I agree with the jury deadlocking on the death penalty and a mistrial being declared and the judge having to now decide between life in prison without parole or life in prison with parole in 25 years? Sure, if that's what the law says happens now.

Even people serving life without parole often get out of prison long before they die.

No prison wants to pay for the upkeep of geriatric inmates.
 
Avoiding the death penalty in this case is not a surprise now. This is now the second jury that has been unable to agree, this case happened to end up with a great deal of coverage in the court of public opinion, and someone ended up making a movie about the whole fiasco. Given the nature of the crime I would be impressed if the judge handed down a possibility of parole no matter what Arias' attorney argues, the best we can look at here is life in prison.

There's compassionate release, among other things. They tried that with Susan Atkins (one of Charles Manson's girls).
 
This jury is made up of idiots, she totally premeditated this murder and she be put to death. But now instead the taxpayers foot the bill and she gets to keep her life.. Sad day.

I wouldn't have an issue with life meaning you come out in a pine box. I find it preferable to the state killing people.
 
Her sentence will be either life in prison or life with the possibility of parole after 25 years but the second hung jury means the death penalty is no longer on the table.

Now that the death penalty is off the table, life in prison may be the suitable choice for the vicious brutal murder she was found guilty of committing.

Had to be so tough on the family to go through this a second time hearing this verdict.
 
Perhaps the law of the jungle justice will prevail and dear little Jodi will suffer the same type of shower scene demise in prison that her former boyfriend suffered in their home.


Not likely. Fellow inmates in a womens prison tend to abuse or kill women who have killed their own children. Not those who kill men. In fact, her viciousness might well make her a predator in prison.
 
Either way she'll get out of prison an old woman if she lives to get out at all. Sounds about right.

I hope she lives and extremely healthy and long life behind bars. She doesn't deserve the freedom that death would bring; she deserves decades to contemplate and, I hope, experience genuine remorse.
 

One of the other jurors said he thinks that the holdout was against the death penalty under all circumstances. That means that juror lied when she was chosen to be on the jury. You have to say you are open to the death penalty when you sit on a jury for a death penalty case. The holdout juror was questioned by the other jurors about her belief in the death penalty, and altho the holdout said she wasn't against it, the other jurors gave examples of various death penalty crimes, and they couldn't come up with one example where the holdout would vote for the death penalty.

I hope Arias never gets out of prison, at least.

true, if she or that idiot who probably killed her daughter in Florida but walked both looked like Hillary we'd never have heard of either one. Same with that girl in Italy who was framed by one of the most inept judicial systems I have ever seen
