yes they can have their status changed, but they must seek to do that.......if they do not they are illegal aliens.
It looks like you're basing your belief on the premise that those who are here on such visas aren't aware of what their responsibilities and opportunities are, as if they're here with no knowledge and no guidance of the immigration process.
Here's a clue: the overwhelming majority of them DO know what they can and can't do, and the immigrant community of which they are a part helps guide them and encourages them to do what's necessary to get their permanent residency. I'm very close to the local immigrant community - I used to work for Immigration for a time, and my closest friend (outside my family) was a District Adjudicating Officer for Immigration...
...so in other words, what I'm telling you is that the overwhelming majority of those who are here on H-1B visas do NOT ever become illegal immigrants (because they know that if they ever do so, then once they are caught, then they'd never be able to get such a visa again).
