House GOP File Lawsuit Against Obama

Here's the problem MMC. Obama can certainly determine that illegal aliens will not be prosecuted. That is wholly within his power as chief executive. However, Obama cannot claim that these illegals are here legally by virtue of his order, and reward them with work permits and so on. That is not within his power. That power resides with congress.

Exactly, nor can he create any new program. Also, his cost for Background checks would be astronomical.


At current staffing levels, USCIS issues about 1 million green cards per year. And when Obama enacted his first executive amnesty, the Deferred Action for Childhood Arrivals in 2012, wait times for legal immigrants to get their visas tripled from under five months to over 15 months. Only about 1 million illegal immigrants were eligible to apply for DACA amnesty and only about 600,000 were given amnesty......snip~

I'm pretty sure that Congress passing legislation should be pretty easy if they are 'vehemently' against it.

But they are not. At least not all of them. And the sensible part of the GOP knows by going ape**** over the issue t is going to really kill them with voters in 2016. But the dominant nutbag part of the party doesnt get that, and will quite likely torpedo the party over this issue over the next year.<snip>

You would THINK a bunch of adults would know this and act accordingly. But apparently there's a greater likelihood of me waking up naked tomorrow with Sidney Crosby than politicians acting smartly.

On the surface, that sounds rather positive. That means policy riders on the appropriations bills.

McConnell promised to allow amendments on the floor from members of both parties, meaning there will be a lot of roll call votes on these riders, and therefore numerous opportunities in 2015 to affect policy via the budget process......snip~

Right. He cannot have it both ways. Either he is willing to offer small appropriations bills that defund the left or he capitulates. Given his history I expect the Establishment Republicans to make lots of noise and then to fold like an inexpensive tent.

Any legislative action taken (even after January) requires the President's signature. A compromise with the President is going to be virtually impossible after the President has taken this EO action. There will be no compromise. A Republican bill to reform immigration would not meet the President's requirements, he would not sign it, and the EO would remain in place until legislation is passed on the President's terms. That's just the way it works. There is certainly little likelihood of both houses of congress overturning a veto.

The EO stays unless judicial action is taken. An injunction could be issued by a lower court prohibiting the government from issuing the work permits and temporary resident card pending the outcome of the suit.

I'm just laughing because obviously the comparison of Obama to HITLER is more appropriate..... After all, the lawsuit is about Obama delaying the employer healthcare mandate. If that's not a HITLER!!! type act, I don't know what is! "Tyrant" just doesn't quite capture the enormity of the evil at work here. :roll:

They won't win. Even if a judge rules in the House GOPs favor at the lower level, this will eventually make its way to the Supreme Court where it will be struck down as fibulas. Congress already has two Constitutional mechanisms to "correct" presidential actions or wrong-doings:

1) Pass bills which is their primary enumerated power; and,

2) Impeachment.

If they truly believe the President has overstepped his bounds, IMPEACH HIM!

If they truly believe that the EOs he has written fill those grey areas of a given law, CHANGE THE LAW or pass a bill that fixes the freakin' problem!!! But...

DON'T WASTE THE PEOPLE'S TIME WITH THESE POLITICAL STUNTS!!!

Well they did call up a bill and like all thought.....Reid and the Demos didn't let it make it to BO's desk. They did this before they went on break. So the Bills will start coming and Reid will be done playing head games.

I doubt it. That's probably why the republicans wanted to take over the Senate. Some things are simply more important that politics.
 
Regardless of your political leanings, don't you want to ensure that your President doesn't overstep the bounds of what a single person should be able to do vis-a-vis the legal/justice system in your country?

Absolutely, but overturning this executive action would open a huge can of worms, and put the validity of every other past executive action for the past 200+ years into question.

It still amazes me, frankly, that a country that was born out of the tyranny of a monarch so readily gave what seem to me regal powers to a single man/woman who happens to hold the Presidency.

We seem to like strong leaders.

I don't disagree, but the exercise of transparency is important. I don't mind an Obama veto politically.
